His mom was a US citizen and that makes Obamessiah one too. There is no precedent of the Supreme Court ever addressing the issue of the meaning of "natural born citizen. 14th Amendment guarantees the citizenship by birth, regardless if child was born overseas or not.

That means he was NOT born in a condition that would automatically grant him citizenship if the stories of his being born in Kenya/elsewhere are true.

His Mom was not military, government, old enough, or on a tourist visa or something according to these stories.

Along this thread, there are several cases where somebody new registers and then comes up with a post that says something along the lines of "the world is flat, therefore Obama is a citizen and eligible to serve as President" and you suspect that the new poster might be a troll setting up a post that can be referenced as legitimate dissent.

I didn't have any trouble comprehending your post. You are simply dead wrong. And there is an exhaustive legal opinion set out here (http://www.freerepublic.com/focus/f-news/2040753/posts) that covers the waterfront on all of the possible legal issues other than Sec. 1409 which as set out in the thread has an effective date for persons born after November 1986.

So you come up with something to the contrary--well which word of #2040753 or which statute or what do you not agree with? Here's the law; there isn't any room for argument on the narrow point--Ms. Dunham's citizenship makes a difference but only in a very narrowly defined statutory area which Obama does not fit.

If it proves out that Obama was born in Kenya, he is not even a citizen much less eligible to serve as President.

Actually the 14th Amendment only applies to "All persons born or naturalized in the United States, and subject to the jurisdiction thereof".

The 14th Amendment does not automatically confer natural born citizenship to those persons born outside the United States or it's jurisdiction regardless of their parentage, or in Obama's case the illegitimate child of a American Mother and a Kenyan Father, possibly born elsewhere but issued a Hawaiian Birth Certificate (which according to Hawaii's own website they will issue to those that ask for one).

Who is Eligible to Apply for an Amended Certificate of Birth?

As provided by law (HRS §§338-17.7, 338-20.5), the following persons may apply for an amended certificate of birth:

• A person born in the State of Hawaii who already has a birth certificate filed with the Department of Health and

For a person born in the State of Hawaii who already has a birth certificate filed with the Department of Health and has undergone a sex change operation:

• An amended birth certificate will be prepared upon receipt of an affidavit of a physician that the physician has examined the individual and determined that the individual has had a sex change operation and the sex designation on the individual’s birth certificate is no longer correct, subject to further investigation and submission of additional information if deemed necessary, and payment of fees.

For a person born in the State of Hawaii who already has a birth certificate filed with the Department of Health and a legal determination of the nonexistence of a parent and child relationship for a person identified as a parent on the birth certificate on file has been made:

• An amended birth certificate will be prepared upon receipt of a final order, judgment, or decree of a court of competent jurisdiction that determined the nonexistence of a parent and child relationship for a person identified as a parent on the birth certificate on file and the person, and payment of any fees.

For a person born in the State of Hawaii who already has a birth certificate filed with the Department of Health and previously recorded information in relation to the person’s surname and/or the father’s personal particulars has been altered pursuant to law:

• An amended birth certificate will be prepared upon receipt of an affidavit of paternity, a court order establishing paternity, or a certificate of marriage establishing the marriage of the natural parents to each other, and payment of any fees.

For a person born in a foreign country who has been legally adopted in the State of Hawaii:

• An amended birth certificate will be prepared upon receipt of a certified copy of the adoption decree or the certificate of adoption, and payment of fees.

Note: Any additional application forms that may be required will be provided by the Department of Health after receipt of the necessary documents in support of the establishment of an amended certificate of birth.

Simple question is a child born outside of the United States that has such an amended adopted birth certificate an American Citizen?

According to the 14th Amendment No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Or in other words the states do not have the right to grant or deny the rights of citizenship based upon their own (the states or in this case Hawaii) laws.

As we know Obama was Legally adopted in Indonesia By Lolo Soetoro, it is possible that he has an Indonesian adopted birth certificate that was replaced by a Hawaiian one which changed his name to Barack Obama by his Hawaiian grandparents since his mother stayed in Indonesia.

The real question is what is on his original birth certificate if he even has one and where was it originally issued?
