Dad who pluggedprowler spurns deal
New York Daily News ^ | 4/08/03 | NANCIE L. KATZ

A Navy veteran who shot an intruder in his toddler's bedroom decided against pleading guilty to a gun charge yesterday. Ronald Dixon rejected a deal that would have spared him from having to do jail time because he does not want a criminal record, his new attorney said.

Brooklyn District Attorney Charles Hynes initially charged Dixon, 27, with possessing an illegal weapon - an unregistered pistol - after he shot a career burglar he found prowling in his Canarsie home on Dec. 14.

Last month, Hynes reduced the charges to misdemeanor attempted weapon possession, which carries a maximum 90-day jail term. Hynes said he would only ask Dixon to serve four weekends in jail in exchange for a guilty plea.

Criminal Court Judge Alvin Yearwood changed that deal to a year's probation.

"After the people reduced the charges, this was put on for possible disposition," Yearwood told Dixon and his new attorney, Joseph Mure, yesterday. But the Jamaican immigrant declined the deal and left the courtroom without comment yesterday.

"That means he would have a criminal conviction, and that is a big concern to us," Mure said afterward.

Dixon gained widespread sympathy after he was charged with a crime. In a tearful interview, Dixon told the Daily News he could not afford to spend any time in jail because he was working seven days a week to support his family and pay his mortgage.

listen man, it's just NYC that ruins it for the rest of us up here! As I said, it pains me to think I could care less if NYC burned to the ground!

Rural Upstate NY is one of the most conservative places around. We just can't match NYC in voting numbers! There are 12 million people living in about 10% or less, area wise, of our state. The other 4 million or so scattered across the "frontier" can't out-vote the socialists.

there are two New Yorks

"The words don't mean what they say they do."

I seriously doubt that you've even read the state law in question.

On the extremely improbable chance that you have, what does it say?

AllSmiles had been around a while before letting the true colors come shining through. That means that vaporization was a JimRob special. Thanks, AM

People will differ as to where that line is drawn when, once crossed, they feel that their freedom has been encroached on by another's.

No person group or government shall imitate force, threat of force or fraud against any person or their property.

The line is drawn by impartial juries.

If a person thinks they have been harmed by another person they can take the person to court and do their best to convince an impartial jury that they have been harmed. If they succeed they can gain restitution for their pain and suffering that the defendant inflicted on them.

IMO, I think there is very little analysis necessary. See Amendment II of the U.S. Comstitution. I am always open to considering the opinions of others. If you disagree, let me know why. I will either explain my position in further detail or consider chaning my position altogether.

Nope. Not sure. I do not approve of banning him because he was arguing a point of view, however.

I'm with you, saurpod. Even though I completely disagreed with AllSmiles, from what I saw, I do humbly suggest that the moderator may have been a bit hasty in giving him a "total zot". Of course, he may have said something completely off the wall that I did not see before he was gone.

similar situation here in GA, with Atlanta ruling the roost.
I understand it is the same deal in Illinois with Chicago.
There might be some justice in the idea of turning all urban areas into their own city-states, freeing the non-urban remainder of the states to have laws of their own.
The founders never envisioned such lopsided population concentrations either (for those who like to keep spouting off about what the founders did and did not envision)

Interesting stuff. Let me think on it.

That's not exactly the well-reasoned, detailed response I was expecting from you. I'm disappointed. (Seriously)

Seriously?! HA! Yet you make no mention of the rest of his reply (reposted below) as you conveniently omit it. What's up with that???

Hi Roscoe. What do you think would be an appropriate punishment for Dixon (if any)?

I didn't feel that it needed addressing, but, as I was obviously mistaken, allow me to take the opportunity now:

-- And you're quibbling as to a 'Utopia', no one here said there is one.

I am simply trying to illustrate the point that "we all" are not going to agree on interpretation of the Constitution, or any body of law. Call it quibbling if you will.

"Dixon used a 9-mm. pistol legally purchased in Florida that he says he was in the process of registering here." -- PATRICE O'SHAUGHNESSY, DAILY NEWS STAFF WRITER, January 19, 2003

Sounds like Brooklyn District Attorney Charles Hynes might have a political ax to grind. Hard to discern what the facts in the case might be from all the ignorant posturing by the fanatics in the thread.

Rights of (NEW YORK STATE) Occupants of Premises to Use Force (Display Guns) to Stop, Expel and Arrest Defiant Trespassers (or suspected Thieves, etc.)

THIS RELATES TO NYS PENAL CODE 35. ANYONE INTERESTED IN THIS CASE SHOULD READ BOTH NYS PENAL CODE 35 AND THE PRECEEDING DOCUMENT BY Mr. Mark R. Ferran !!!

"Registration will not prevent criminals from obtaining firearms, and is not intended to prevent criminals from getting firearms."

Ironically, criminals are protected by the law from having to register any guns, because by law they can't own them, and therefore having to register them is a violation of their 5th Amendment rights of self-incrimination.

You're kidding, right? Actually it's easier for a crook to get a gun in NYS than it is a law abiding citizen.

Hence the saying, "When guns are outlawed, only outlaws will have guns."
