Sorry but the person clearly did what they did with the intent to cause harm... law’s completely clear on this. You engage in any activity with the intent to harm another you are breaking the law. And if what you did actually doesn’t cause harm you are broke other laws.
Intentionally sending someone you know to be epileptic a strobing video in attempt to cause them to have a seizure you are not only a criminal but an asshole to boot doesn’t matter the medium in which you delivered it.

So if someone is such a fragile flower that you say "oggidy boogedy boo!" and they have a heart attack, you are responsible for their heart attack? The fact that they are abnormally weak has nothing to do with it?
Obviously we need some "safe spaces" for people too weak to live a normal existence. Ought to be laws keeping them from encountering stuff that is going to kill them.
