On March 23, 1933, the Reichstag assembled at the Kroll Opera House under turbulent circumstances. The position of the Centre Party, the third largest party in the Reichstag, turned out to be decisive. After Hitler verbally promised party leader Ludwig Kaas that President von Hindenburg would retain his power of veto, Kaas announced the Centre Party would support the Enabling Act. Ultimately, the Enabling Act passed by a vote of 44184, with all parties except the Social Democrats voting in favor. The Enabling Act, along with the Reichstag Fire Decree, transformed Hitler's government into a de facto legal dictatorship.
On August 2, 1934 President von Hindenburg died. The previous day, the cabinet had enacted the “Law Concerning the Highest State Office of the Reich”. This law stated that upon Hindenburg's death, the office of president would be abolished and its powers merged with those of the chancellor. Hitler thus became head of state as well as head of government, and was formally named as Führer und Reichskanzler (leader and chancellor). Up until this point NOTHING that the Parliament and Hitler did was illegal or unconstitutional. The Night of the Long Knives, the Concentration Camps or the forcing of opposition leaders into prison, ALL PERFECTLY LEGAL under the Enabling Act of 1933.
