Anybody that hasn’t had a DWI here would KNOW the only reason for her to refuse the test was to buy time for the drink to wear off. The cop knew this was a stall.

By the way...that is why the PENALTY for refusing a breathalyzer at the scene is so heavy.

Total BS. Female out late at night by herself, AND SHE KNOWS SHE HASN’T BEEN DRINKING and the cop says he smells alcohol? If I’m that female (I’m a male, btw) I go into survival mode because a cop is lying to me.

If the cop smelled alcohol ON HER BREATH, as he stated he did, she would blow a reading. Period. She didn’t.

Breathalyzers have been rigged by corrupt law enforcement agencies since they appeared on the scene. I remember in my teens when a local judge was arrested for DUI and refused to blow. When asked why, he told the cop, "These things are rigged all the time."

Let's put some other facts on the table, too.

From the husband's letter:

The NCAJ Convention was being held at the Hilton Riverside Hotel in Wilmington, North Carolina.

From the WWAY Channel 3 news story:

Hoyt Tessener says Wyrick pulled Gina Tessener over just before the Wrightsville Beach bridge.

A Google Maps driving direction search from the hotel to the bridge shows a driving time of 19 minutes.

Add to that the time it takes to walk from a banquet room in the hotel to one's car, to buckle up, to start the car, and to leave the hotel grounds. There might even have been a bathroom stop on the way out to the car and a phone call to the husband telling him she's leaving. Let's give this another 15 minutes.

Now add to this the time it takes for the trooper to pull the woman over, walk to her car, engage her in conversation, and then conclude that she had been drinking and ask her to step out of the car. Shall we give this 5 minutes?

We're now at 47 minutes since the alleged sip of wine and the beginning of this incident.

From the letter:

After Wyrick puts Gina in the backseat of the cruiser, Wyrick returns to our vehicle. Wyrick climbs into the driver’s seat and stays in the vehicle for seven or eight minutes.

Now let's add a few minutes to handcuff the woman and put her in the back of the cruiser. Then let's add 5 minutes for the trooper to "shut off" the woman's car.

Now we're at 54 minutes since the alleged sip.

Another Google driving directions search indicates that it's another 4 minute drive from the bridge to the police station. Add a few minutes to get the woman out of the car and into the police station, and we're at one hour.

Your posts sound like you think this woman was drunk and that all traces of it had been cleared from her system at just the moment that the test was conducted.

By the facts in the stories, it was likely to be only a 13 minute difference between the time the woman was stopped and when she was taken to the police station to take the breath test.

At the station she blew a 0.000. How drunk do you suspect her to have been 13 minutes earlier to have blown a 0.000 now, if she was stalling as you claim?

How drunk would she have to have been when leaving the hotel, to have "smelled" of alcohol 47 minutes later, and then to have blown 0.000 13 minutes after that?
