The argument was never about whether she was legally drunk sir. The debate was about could she be at zero an hour after having a glass of wine.

The tacit assumption behind your claiming that she was "stalling" would be what, then, if not that she was legally drunk at the time?

You're really not very good at this, you know.

Uh, maybe you aren’t keeping up. She first said she had nothing to drink. Then the officer’s notes said she had a small sip of wine.

I NEVER said she was stalling to pass the test. I said the reason she COULD be at zero even though having had a sip of wine was because an hour had passed since she had been stopped and that would mean that even if she had had the sip of wine the officer insisted he smelled on her when he stopped her it would be out of her system.

The issue we were debating way back then was whether the officer could have smelled alchohol on her breath and she still gets a 0 an hour later.
