Wrong: A scientific theory is of a higher order than proof or a fact. Evolution is a observed fact, the explanation of the observed fact (evolution) is the Theory of Evolution.
So, someone has actually observed something rise from nothing, observed life rise from non-life, observed multi-celled organisms rise from single-celled organisms, observed intelligence rise from non-intelligence? You've got yourself a scoop there, buddy.
And who's to say that this Tiktak, or whatever it's called, gave rise to anything? Where's the proof that this seemingly intermediary species is something more than simply some dead-end that went extinct, that it isn't related to any existing specie? The blindspot of the evolutionists is that they assume their speculation is fact, and then interpret new evidence from that assumption. Their conclusions are corrupted by their biased speculation.
Key word is "THEORY". Some interesting comments on this thread but when it comes right down to it, evolution is just a "THEORY".
Ok, not that I really ever like getting into to this, but evolution is ABSOLUTELY NOT AN OBSERVED FACT.
Paleontologists have studied different fauna and flora from different aged stratas, found different fossil remains, and have made INFERENCES as to the relation of the observed fossil finds. NO ONE, unless thay are millions of years old, can have actually observed evolution. but if you believe in evolution, that could not have happened either because you would now be extinct.
Really? When did anyone observe a fish evolve into a reptile? Or anything else into something more complex? The only thing anyone has ever observed is mircoevolution which changes traits that are often reversable. No new life forms have appeared. You Darwin Fundies got quite the pseudoscience/religion going.

Who observed it? Obviously no one did, evolution is based on interpretation of available data. Depends on the interpreters agenda.
