If nothing had been mandated, there would have been no trial. The science teachers weren't voluntarily going to list Pandas as an acceptable scientific resource, or list ID as a scientific theory.
If you want to argue that a school board has no power to issue disclaimers, then argue that. Just the facts man, just the facts.
