I'm inclined to think the judge believes the story that the brothers told about dropping them off at the beach near the Marriott. If that's the case, there is no evidence of a crime that they would have committed.

It's a long shot, but there might be.
If she died as result of a date rape drug (or died of any other cause while under its influence, the body would not metabolize the drug and there still may be some small trace of it in the remaining tissue. If some trace is found and if it can be established that Joran has used this MO before...well, you see where I am heading with this.
