House Majority Leader Tom DeLay apologized Wednesday for using overheated rhetoric on the day Terri Schiavo died, but refused to say whether he supports impeachment of the judges who ruled in her case.

At a crowded news conference in his Capitol office, DeLay addressed remarks he made in the hours after the brain-damaged Florida woman died on March 31. "I said something in an inartful way and I shouldn't have said it that way and I apologize for saying it that way," DeLay told reporters.

DeLay seemed at pains to soften, if slightly, his rhetoric of March 31, when Schiavo died despite an extraordinary political and legal effort to save her life.
"I believe in an independent judiciary. I repeat, of course I believe in an independent judiciary," DeLay said.
At the same time, he added, the Constitution gives Congress power to oversee the courts.
"We set up the courts. We can unset the courts. We have the power of the purse," DeLay said.
Asked whether he favors impeachment for any of the judges in the Schiavo case, he did not answer directly.
Instead, he referred reporters to an earlier request he made to the House Judiciary Committee to look into "judicial activism" and Schiavo's case in particular.

Good question lula, if I or anyone in my family is ever in a situation like Terri was I don't want the justshutupandtakeits of the world within a 100 mile vicinity.
This from a person who calls Keyes a "nut," and Savage a "screaming retard." Central Scrutiniser is on record as supporting Terri's "wishes to die." Therefore CS considers Michael Schiavo a credible source (who could easily pass a lie detector test).
CS's mantra is "rule of law" --- like a good German, CS considers the existing law paramount. If the law lets an atrocity slip through, so what? But CS says Terri had been dead for 15 years, so a single judge ordering her starved to death committed no atrocity. And the law passed by Congress to have Terri's case reviewed, what of the rule of that law?
That world will come to you. You don't need to find it.

I don't believe I missed that at all. The three branches are not independent, they are linked by the US Constitution. They do not operate by different constitutions.
Delay is correct, Congress controls the extent of the judiciary, how far it may reach into the lives of the citizenry.
To say that the branches are 'equal' is not to say for example that the Executive branch need not respond to Congressional inquiries, need not show up under subpoena, need not respond to impeachment proceedings and verdicts.
To say that the Judicial branch is 'equal' is not to say that judges need not respond to Congressional subpoenas, need not consider laws passed by Congress, need not abide by the budgetary allocations set by Congress.
We have seen Congress cede its power to the other branches. It no longer 'declares' war, it no longer intercedes in bringing about floor votes over innocuous debate by a minority and it no longer affirms the proper layout of the judiciary.
Madison vs. Marbury has been left unchallenged not because the issues it embodies are complete and unequivocal, but because the conduct of the courts until recently in the last decade and a half have been self-restrained in a low profile state. All that is changing presently. Although Madison vs. Marbury will not likely be resurrected, judges will find themselves increasingly in contempt with the other branches until they relearn the wisdom and practicality of self-restraint.
I was speaking in general about people who advoated Terri's death and then scream when they are compared to those who advoated and did these things in the mid 20th Century.

This isn't failed anything that I say. It's not even emotional. It's the cold hard truth of what happened to Terri and those like her and what people like you advocate.

Yep, I think Keyes is a nut and I dislike Savage, that is an opinion on a subject not a poster. Savage and Keyes are subjects for debate and I address them that way. Now, if I were posting to those two people, as people, I would temper my comments and talk to them like I am to you.

Be careful with your words, you got most right, but then you argued emotionally, not logically. I don't think it is the Feds role to get into this matter, it is too much government. Terri's situation happens every day, this was just a case where everyone used her to further their ends. I mean, we had freepers gushing about how great Jesse Jackson is, how strange is that?

The problem is just how she qualified to be on Medicaid when her HINO and guardian lived in a $400,000 house and drove a Mercedes. The lawyers got paid most of her rehab money them finagled the laws to let the taxpayer foot the bill.

What I saw were two loving parents willing to take on the responsibility of caring for their daughter. What I also saw in Greer and Mikey were two Ice Men who just came out of a cave. No I don't want to ever be in that situation but should it happen putting someone to sleep like an animal is not an option and never will be.
