Many of the 11,000 cases are probably wrong as well. Terri's plight is going to blow the whole mess out of the water. I've already learned that there is no way I would let medical professionals starve and dehydrate me to death!

The ONLY judge to try "fact" was Greer, who has his own conflicts of interest in this particular situation.

All the other judges reviewed process and law, not "fact".

Greer should just have a gold crown placed on his head - in fact, he should be allowed to starve anyone he likes. After all, he's a (tremble) JUDGE!

You don't have to be a Rhodes Scholar to see the similarities between radical Islam and radical Christianity.

But there is only one radical side advocating killing the non-believers.

exactly! a court is constrained in appellate situations from refinding facts. i would be interested to talk to antonin to see what he thinks should be done. i have NO DOUBT that as a devout catholic (his son is a priest in a neighboring parish here in noVA), he is in favor of her being allowed to live. and again, i have no doubt that it probably pained him greatly to not be able to afford her relief. i am not sure what the legislation provides as far as review. personally i would favor a complete de novo review, with new MEDICAL evidence. but i doubt that would ever have passed the congress.

Yeah, the government should stay out of personal issues.

If doctors and judges want to off helpless people, it's their (bleeping) business and the gov't should butt out!

I believe the reason MS won't turn Terri over to her parents is twofold.

#1. Trying to carry out her wishes. You may not believe him. However, several courts have found his testimony credible. Additionally, I don't know anyone who WOULD want to live this way for 15 years.

#2. I think that MS is convinced there is no hope for his wife. Court appointed doctors have said she is PVS with no hope of recovery.

#3. I think MS is trying to prevent the Schindlers from keeping their daughter alive even in the event she needs multiple amputations.

Court testimony provided by members of the Schindler family included very personal statements about their desire and intention to ensure that Theresa remain alive . . . at any and all costs. Nearly gruesome examples were given, eliciting agreement by family members that in the event Theresa should contract diabetes and subsequent gangrene in each of her limbs, they would agree to amputate each limb and would then, were she to be diagnosed with heart disease, perform open-heart surgery. Within the testimony, as part of the hypothetical presented, Schindler family members stated that even if Theresa had told them of her intention to have artificial nutrition withdrawn, they would not do it.

When it comes to government interferance, extraordinary cases are the precident and the foothold that opens the door for further manipulation of peoples rights.
It is obvious that control over people is most important when congress becomes involved in any matter where people hold their line without compromise.

Now, why is it you want to kill this woman so badly? Did your mother do something to you, or was it the rejection of other women in the third grade when everybody wanted to play doctor "but don't let Howlin in", if I recall the words correctly?

Senator Frist is correct. Judge Greer should have complied with the subpoena.

This Probate Judge should not be allowed to decide who lives and who dies, especially based on this case.

I haven't seen this disccused before, but isn't this judge on the board of the hospice where Terri is incarcerated? If Mikey really has spent all Terri's money, then who would pay for her care? Or would the hopsice have to foot the bill?

Terri is a young woman and could live another 40 years. This judge should recuse himself simply based on the fact that he is on the board of this hospice and has a conflict of interest. He has a duty as a board member to protect the hospice. He can't fulfill that duty AND protect Terri's interest at the same time.

I think I am correct on this. Somebody correct me if I'm not.

It's not beside the point. If I tell my husband that I don't want to live like that, or anyone else for that matter, I expect them to honor that.

And regardless of what you think about MS, several courts of law have found his statements credible that Terri didn't want to live like that.

He did everything he could for her in the initial years and it wasn't until the medical malpractice suit was litigated and doctor after doctor testified under oath that she was PVS and there was no hope that he gave up hope, imo.
