by Joe Callen A federal appeals court ruled late Monday that the Trump administration may deport hundreds of thousands of illegal alienswho previously received temporary protected status for "humanitarian" reasons, in some cases decades past the event that spurred the temporary reprieves. The 2-1 ruling by a panel of the U.S. 9th Circuit Court of Appeals overturned an injunction protecting aliens from El Salvador, Haiti, Nicaragua and Sudan from being deported pending litigation. The Trump administration ended their protections, saying their home countries were now safe for them. The decision affects 300,000 non-citizens here illegally -- and a staggering 200,000 of...

WASHINGTON (CN) – President Donald Trump announced six new judicial nominees on Friday, including two to seats on the once reliably liberal Ninth Circuit and four to federal courts in California. One of the nominees to the Ninth Circuit will be familiar to senators, as Trump has now three times chosen Patrick Bumatay for a federal judgeship. Trump first chose Bumatay, a prosecutor in the Southern District of California, for a seat on the Ninth Circuit in 2018, but the Senate never took action on the nomination. Trump tapped him for a judgeship again earlier this year, this time for...

The Ninth Circuit Court of Appeals on Thursday upheld a lower court decision that ruled said sanctuary cities do not conflict with federal immigration laws. The decision comes after the Trump administration challenged multiple aspects of California's sanctuary city designation, which protects illegal aliens from Immigration and Customs Enforcement (ICE) agents. From the Times of San Diego : The U.S. 9th Circuit Court of Appeals upheld Senate Bill 54 , otherwise known as the California Values Act, overriding the federal government’s assertion that it violates the Constitution’s supremacy clause that states federal law preempts state law when the two are...

Washington (CNN)President Donald Trump struck a nakedly political tone during a Thanksgiving call with US service members stationed around the world as he steered the conversation toward controversial political topics. Speaking with a US general in Afghanistan, Trump likened the fight against terrorists to his efforts to prevent a group of migrants from illegally entering the United States, and he assailed federal judges who have ruled against his administration. The President also pressed the commanding officer of a Coast Guard ship in Bahrain on trade before touting his trade policies and arguing that "every nation in the world is taking...

Diversity and tolerance is a one way street Via The DC Students in a California school district will not be allowed to wear American flag T-shirts on Cinco de Mayo, due to concerns that such displays of patriotism would inflame racial tensions by offending Mexican students on their holiday. The district’s policy concerned many free speech advocates, but was upheld by the Ninth Circuit Court of Appeals. In response, Tea Party groups plan to protest outside Live Oak High School in Morgan Hill. And they will be wearing American flag T-shirts. “They silenced a symbol of patriotism and freedom in...

A cross atop Mount Soledad in California is an unconstitutional religious display on government land and must come down, a federal judge in San Diego ruled late Thursday. U.S. District Judge Larry Burns ordered the cross, which honors veterans, must be removed within 90 days -- a decision that could result in the case being sent back to the U.S. Supreme Court. Burns immediately stayed his order pending an expected appeal.

Atheist activist Dr. Michael Newdow announced on his website that after 6 years of litigation in federal courts, his constitutional challenge to the Pledge of Allegiance in California public schools is “over.” Newdow indicated for “reasons that are best not divulged” that he would not appeal the case to the Supreme Court.

That leaves intact a decision of the Ninth Circuit Court of Appeals in San Francisco last year holding that the words “under God” in the Pledge do not establish a religion.

Conservative radio talk-show host Rush Limbaugh has said many times that elections have consequences. One of the more-far-reaching powers that sitting Presidents hold is the ability to influence the Leftward or Rightward tilt of the entire Republic by the appointments of Justices to the Federal Circuit Courts and to the Supreme Court. This Presidential legacy can span two generations or more, given long lives for particular Judges who are appointed for life and can be removed only through impeachment. President Obama has chosen another leftist, Goodwin Liu (pictured above), from the University of California at Berkeley Law School to sit...

ANCHORAGE, Alaska -- A ruling Thursday by the Ninth Circuit Court of Appeals has cleared the way for Shell Oil to resume its exploration and development in the Beaufort Sea. The court's ruling says the Bush administration was correct in not demanding a new environmental impact assessment for the company's drilling leases. The suit filed by the North Slope Borough and the Alaska Eskimo Whaling Commission alleged that the Minerals Management Service was supposed to have included additional environmental work in its studies before a lease sale took place in 2007. The court rejected those claims. The decision allows Shell...

SAN FRANCISCO (Reuters) - A federal court case which could legalize gay marriage in the United States will begin trial in January 2010 with high-profile lawyers but not longtime gay and conservative antagonists lined up on opposite sides of the debate, a district judge ruled on Wednesday. Aiming to speed a contentious case that could be destined for the U.S. Supreme Court, San Francisco District Court Judge Vaughn Walker denied requests to join the case from gay advocacy groups and social conservatives who said they would not be adequately represented. Ted Olson, the conservative lawyer whose Supreme Court arguments put...

Even when Ninth Circuit Court of Appeals does the right thing - as it did Monday in denying convicted killer Kevin Cooper a hearing on yet another of his dubious appeals - there is always a judge, or in this case five, on the court with an overly active imagination. And those judges don't help the court's results-oriented reputation. On June 2, 1983, Kevin Cooper escaped from the California Institution for Men at Chino where he was serving time under a phony name for burglary. He hid out at a Chino Hills home until June 4, when he broke into...

Believe it or not, the Ninth Circuit Court ruled today that the second amendment restricts the right powers of state and local governments to interfere with the individual right to gun ownership. The decison even observes that the right to bear arms is “deeply rooted in this Nation’s history and tradition.” Notes Cato Institute's Ilya Shapiro, "I rarely get a chance to say this, but the Ninth Circuit gets it exactly right." On a related matter, I just got around to Brian Doherty's Gun Control on Trial: Inside the Supreme Court Battle Over the Second Amendment. It's a terrific accounting...

More news on the Ninth Circuit Court of Appeals continued war against reason. In the case Fields v. Palmdale (November 2, 2005), parents sued the Palmdale School District for giving a survey, which included ten questions of a sexual nature, to students between the ages of seven and ten. The School District sent a note home to parents asking for parental consent to engage their children in a survey of early trauma. The note did not mention sex. The School District, collaborating with the School of Psychology and Seymour, developed and administered the questionnaire to first, third, and fifth grade...

The Supreme Court yesterday ruled in favor of police who obtained a search warrant for a man's home in anticipation that he would accept mail delivery of child pornography he ordered as part of a sting operation. The unanimous ruling in the case United States v. Grubbs, said such "anticipatory" warrants obtained by police do not violate the Fourth Amendment rights protecting individuals from unlawful searches and seizures. Writing for the court, Justice Antonin Scalia said police can obtain such a warrant prior to the actual commission of a crime as long as they have probable cause to believe an...

Just when you thought kids were safer now that Michael Jackson is out of the country ... In Kelo vs. New London, Conn., the Supreme Court ruled 5-4 that it was OK to rob people of their property if the community (community of government) could collect more taxes if somebody else owned the property. Now, out west, the legendary 9th Circuit Court has, in essence, proclaimed that the government has a sort of sexual eminent domain over children in public schools. "Eminent domain" is the right of the government to seize peoples' private property for public use. "Sexual eminent domain"...

Journalist or Willing Dupe?March 17, 2005 Here is another saga about a decades-old half-baked ruling from the quacking ducks on the 9th Circuit Court of Appeals being distorted, misunderstood and misapplied...BUT, still ending up as “the law of the land”. In usual fashion, the culprits are wishfully thinking liberals and a journalist too lazy to check her facts. One of Hartford Connecticut’s most famous citizens, Mark Twain, once advised to “Get your facts first, and then you can distort them as much as you please.” It’s a pity that many in Twain’s home city prefer to skip the former and get...

Arnold's Apology Mr. Schwarzenegger's response to the LATimes sexual misconduct indictment has won praise in various quarters for its deftness. Nimbly did Mr. Schwarzenegger neither deny nor admit the claims of six women, 1975 to 2000, of unwanted touching. Mr. Schwarzenegger did not point out, as I do now, that this amounts to 1 grope every four years, and he had no time to assemble contrary evidence. Surely, with a little time, he could have brought forward at least an equal number--and probably a whole lot more--of women who appreciated his attentions. Instead, Mr. Schwarzenegger apologized for any offense his...

Selfless acts in response to Support Our Troops and the attack on our Nation's Traditions. While PDN was on the air last night with KFBK's Mark Williams, an email arrived. We had been talking about public schools, The Pledge and "So help me God" being removed from oaths of office and swering in witnesses in court. After the call, I opened the e-mail. It read in part: "When you spoke of the message that's being sent to our kids, I knew I had to email you. I've been very concerned with preserving our countries freedom, supporting our armed forces, and the...

KeepAndBearArms.com -- I just went to the NRA-ILA and affiliated official websites to see what they had to say about the Ninth Circuit ruling. Not a word. [Screenshots, time stamped from earlier today: MyNRA, NRA-ILA Main Page, NRA-ILA News Page, NRAHQ.] The Ninth filed their decision on December 5th. This is being written on the 8th. Everyone else interested in the decision jumped on it--especially the anti-defense crowd, who are crowing to anyone who will listen that the end game has been won. The Brady campaign tells us the "Founding Fathers...would be cheering." The Violence Policy Center is claiming this...
