"The district court erred and that the care provided to Kosilek by the DOC does not violate the Eighth Amendment. We therefore reverse the district court's grant of injunctive relief, and we remand with instructions to dismiss the case," the court ruled. The controversial procedure has been postponed, a federal judge ruled today, until the state’s appeal of the operation is decided. The Patrick administration appealed the surgery to the US Court of Appeals for the First Circuit.     A federal judge has apologized to a transgender inmate who has waited years for a ruling on whether she can get a taxpayer-funded sex-change operation. Michelle Kosilek first sued 11 years ago. Two years later, U.S. District Judge Mark Wolf ruled that Kosilek was entitled to treatment for gender-identity disorder, but stopped short of ordering surgery.
