A federal judge in West Virginia has ordered the U.S. Environmental Protection Agency to reverse decades of regulatory practice and begin continually evaluating how many power plants and coal mining jobs are lost because of air pollution regulations. […] Murray Energy Corporation brought this challenge years ago, joined by most of the companies mining coal underground. Thirteen states support the suit, which blames the EPA for the coal industry’s declining fortunes. …

KIGALI, Rwanda (AP) — Nearly 200 nations have reached a deal, announced Saturday morning after all-night negotiations, to limit the use of greenhouse gases far more powerful than carbon dioxide in a major effort to fight climate change. The talks on hydrofluorocarbons, or HFCs, were called the first test of global will since the historic Paris Agreement to cut carbon emissions was reached last year. HFCs are described as the world's fastest-growing climate pollutant and are used in air conditioners and refrigerators. Experts say cutting them is the fastest way to reduce global warming. President Barack Obama, in a statement...

Despite constant claims to the contrary, the issue is not whether greenhouse gas emissions affect Earth’s climate. The questions are whether those emissions are overwhelming the powerful natural forces that have always driven climate fluctuations, and whether humans are causing dangerous climate change. No Real-World evidence supports a “dangerous manmade climate change” thesis. In fact, a moderately warmer planet with more atmospheric carbon dioxide would hugely benefit crop, forest and other plant growth, wildlife and humans – with no or minimal climate effect. A colder planet with less CO2 would punish them. And a chillier CO2-deprived planet with less reliable,...

DENVER – The U.S. Attorney's Office in Colorado has declined to prosecute an employee of the Environmental Protection Agency over a massive mine wastewater spill that fouled rivers in three states, federal investigators said Wednesday. The EPA's Office of Inspector General disclosed that it had found evidence the unnamed employee may have violated the Clean Water Act and given false statements. However, office spokesman Jeffrey Lagda says federal prosecutors declined to pursue the case. He says that in lieu of prosecution, the case will be sent to senior EPA management for review.

A new report has government officials considering setting 10 million acres of across six states in the American west off limits to mining and development to protect the chicken-like Greater Sage Grouse, which is not an endangered species. The U.S. Geological Survey (USGS) report found that much of the Sage Grouse’s habitat sits on top of extremely valuable deposits of minerals including gold, copper, lithium, silver, uranium and many others. The USGS report means that the government’s most restrictive grouse protection plan could kill even more than 31,000 jobs and lead to more than $5.6 billion in reduced annual economic...

The Environmental Protection Agency Thursday unveiled its new online tool to help local officials deal with climate change, and it warns that no state in the nation is safe from disaster. The "Climate Change Adaptation Resource Center," or "ARC-X," provides a map that break the country into eight regions and every single one comes with a threatening warning and long list of threats to human life. "From floods and droughts to dangerous heat islands and other public health effects, communities are facing the very real impacts of climate change," said EPA Administrator Gina McCarthy in unveiling the portal. While the...

Emphasizing the need for congressional action, farm groups renewed their call for reform of Clean Water Act enforcement, following release of a report documenting how federal agencies overreach their authority to regulate farmland. The report, issued last week by the majority staff of the U.S. Senate Environment and Public Works Committee, describes numerous incidents in which the U.S. Army Corps of Engineers and Environmental Protection Agency have tried to expand their authority to regulate what crops farmers grow and how they grow them, based on the agencies' interpretation of the act.

“We can deploy a half a billion more solar panels. We can have enough clean energy to power every home. We can build a new modern electric grid. That's a lot of jobs; that's a lot of new economic activity.” So intoned Hillary Clinton, during the first presidential debate at Hofstra University, New York, on September 26. Where have we heard this before? Like Clinton, President Obama hasn’t a clue how a viable market is created and sustained. Solyndra, if you recall, was awarded $527 million from taxpayers. Each of the temporary, unsustainable jobs created by Solyndra and touted by...

Most people across the world do not care about climate change On Tuesday, the U.S. Court of Appeals for the District of Columbia Circuit heard arguments in the litigation over President Barack Obama’s Clean Power Plan (CPP). If implemented, CPP regulations will require states to develop and bring into force plans to reduce carbon dioxide (CO2) emissions from existing power plants. Arguments against the CPP focussed primarily on its questionable legality. However, the ten judges considering the case should also keep in mind that the rules are pointless. No matter what one believes about the causes of climate change, the...

A Michigan state senator from the Upper Peninsula says the federal Environmental Protection Agency has done everything in its power to indirectly shut down a mine near Marquette. The issue is back in the news because a limited-government legal foundation announced last month it will represent the Marquette County Road Commission in a federal lawsuit against the EPA. The agency has blocked a plan to build a shortcut road to the Eagle Mine in the western Upper Peninsula. In a phone interview with Michigan Capitol Confidential this week, Sen. Tom Casperson, R-Escanaba, suggested that the EPA’s real target in the...

Never before has a presidential election seen a greater contrast in the attitudes of the major candidates towards climate change. Hillary Clinton told delegates at July’s Democratic National Convention that man-made climate change is “an urgent threat and a defining challenge of our time.” Yet Donald Trump calls Clinton’s approach an "extreme, reckless anti-energy agenda," and he told Fox News on July 26 that man-made climate change "could have a minor impact, but nothing, nothing [comparable] to what they're talking about." To determine which position is most reasonable, and what -- if any -- climate change mitigation policy is needed,...

The U.S. Court of Appeals for the D.C. Circuit will hear oral arguments Tuesday in West Virginia v. EPA, the legal challenge to President Barack Obama’s signature global warming initiative, the Clean Power Plan (CPP). The litigation is massive in scale — nearly every state in the union is involved in some capacity. West Virginia is leading a coalition of 27 states who are challenging the rule, while 18 states have come to the Plan’s defense. Each side is joined by activist and industry groups, electric companies, academics, lawmakers, tech companies, and retired dignitaries who together have filed over 70...

There were two sightings of Western yellow-billed cuckoos this year, both in Delta County, the U.S. Fish and Wildlife Service said. The secretive birds are listed as threatened under the Endangered Species Act, and the U.S. Fish and Wildlife Service is considering designating parts of western Colorado as critical habitat for the migratory bird, including lands along the Colorado River through Mesa County. Sightings — which frequently involve people hearing the cuckoo’s distinctive “klak-klak” sound — have been recorded in Mesa and Delta counties in previous years. ... “We have changed the initial map due to comments from the proposed...

The D.C. Circuit Court of Appeals will hear oral argument next Tuesday, September 27 on the Environmental Protection Agency’s so-called Clean Power Plan. The centerpiece of resident Obama’s climate policy agenda, the Plan establishes first-ever carbon dioxide (CO2) emission standards for “existing” (already built) coal and natural gas power plants. The Plan will increase consumer energy prices and impede job and GDP growth yet have no discernible effect on global temperatures or sea levels. However, that’s not why the Court should strike it down. The Court should overturn the Plan because it is an unlawful power grab. The Plan will...

The Environmental Protection Agency has violated the personal privacy of tens of thousands of farmers and ranchers, according to a unanimous ruling issued by the United States Court of Appeals for the Eighth Circuit. The ruling in American Farm Bureau Federation and National Pork Producers Council vs. EPA concerned the federal agency's 2013 release to three environmental groups of a vast compilation of spreadsheets containing personal information about farmers and ranchers who raise livestock and poultry in 29 states. The case also related to similar personal information from farmers and ranchers in seven additional states that had yet to be...

A former senior EPA official known for coordinating with environmentalists slammed the White House for pushing back on agency plans to regulate hydraulic fracturing for oil and natural gas, text messages show. Michael Goo, EPA’s policy chief at the time, texted Sierra Club lobbyist John Coequyt that if environmentalists “want any hope of regulation of fracking then give us more time to try and remove the gun from our head and talk sense into OMB dickheads.” “If you want the oil and gas nsps to give fracking a free pass, as OMB would like then don’t give us the extension,”...

If you’re wondering whether to trust the Environmental Protection Agency on mercury, ozone, climate change or other regulatory actions, you need look no further than how it has handled particulates. EPA whitewashed the toxic flash flood it caused in Colorado. But it says particulate matter smaller than 10 microns (PM10) is risky and worries incessantly about 2.5-micron particles. (A human hair is 50-70 microns; dust, pollen and mold are around 10; combustion exhaust particles are 2.5 microns or smaller.) The tinier specks, EPA asserts, “can get deep into your lungs, and some may even get into your bloodstream.” Eliminating all...

Former Environmental Protection Agency chief Lisa Jackson co-hosted a fundraiser for former Secretary of State Hillary Clinton Wednesday — an ironic twist since Jackson left the Obama administration amid a major email scandal. Jackson co-hosted the Clinton fundraiser with Apple CEO Tim Cook in the San Francisco Bay area, and tickets for the event reportedly cost between $2,700 and $50,000. Jackson currently serves as Apple’s environmental director, and is also on the board of the Clinton Foundation. Jackson took the Apple job after leaving the EPA amid a scandal involving her use of a secret email account. For years, Jackson...
