North Carolina trial judges on Thursday blocked portions of a new law that would transfer Democratic Gov. Roy Cooper’s authority to pick election board members to the Republican-dominated General Assembly. Following a 90-minute hearing, the three state judges agreed unanimously to issue a preliminary injunction sought by Cooper. His lawyers argued that the alterations to the State Board of Elections and county boards in all 100 counties need to be stopped now or his directive in the state constitution to “take care that the laws be faithfully executed” will be harmed irreparably.

State Election Board Chairman Bill Duffey has resigned from the panel responsible for investigating election fraud allegations and setting voting rules, Georgia Gov. Brian Kemp announced Monday. <p>ATLANTA—Georgia’s State Election Board appointed a panel to investigate past elections in Fulton County, taking a step toward a possible takeover of election operations in the state’s most populous county.</p><p>The move comes after a highly contentious election season in which Republicans lost key races in Georgia, including the presidency. After the losses, the GOP-led legislature passed voting law changes this spring that included a provision for the state to take over a county election board if it was deemed to have chronic mismanagement or fraud problems.</p>

The County Election Board for Luzerne County, Pennsylvania has filed a motion today with the Supreme Court for Justice Barrett to be recused from participating in the case. The basis of the motion is one that has been written and talked about by pundits over the last two weeks — whether President Trump’s nomination of Judge Barrett and public statements of support which mentioned pending election law cases have created a circumstance where a prior decision of the Supreme Court, Caperton v. A.T. Massey Coal Co., which has never been overruled, would find a “due process” violation in the rights...
