  • DC Circuit denies en banc rehearing for Parker case

    05/08/2007 10:05:16 AM PDT · by ozoneliar · 391 replies · 5,505+ views
In the Parker case, a 2-1 majority of the D.C. Circuit found that the DC city council's prohibition on handguns, and its ban on using any firearm for lawful self-defense, were violations of the Second Amendment. Today, the full Circuit denied the DC government's petition for a rehearing en banc. The decision states: "Appellees' petition for rehearing en banc and the response thereto were circulated to the full court, and a vote was requested. Thereafter, a majority of the judges eligible to participate did not vote in favor of the petition. Upon consideration of the foregoing and appellees' Fed. R....
  • The EMI Drm-Free tracks, does it change anything? [Vanity]

EMI recently announced it would offer DRM-Free tracks on Itunes for a 30 cent premium. This means people can copy the songs freely. But, does this really change anything from a legal perspective? It is still illegal to make copies of music.
  • Senator introduces legislation to lift D.C. gun ban

    03/29/2007 9:10:40 AM PDT · by ozoneliar · 23 replies · 136+ views
WASHINGTON, DC -- Senator Kay Bailey Hutchison (R-TX) introduced the District of Columbia Personal Protection Act of 2007, a bill to restore Second Amendment rights in Washington, D.C. “The constitutional rights of law-abiding citizens do not end when they cross into the borders of the District of Columbia,” said Sen. Hutchison. “The gun ban has been proven ineffective by the trend of increased violent crime in the District. The citizens of Washington, D.C., deserve to have the same right to defend themselves and their families in their homes that lawful Americans enjoy. “This requires both a legislative and judicial remedy....

  • Need Legal help bad!! Police Misconduct [Vanity]

I don't want to go into details on this board, but suffice it to say I was recently manhandled/assaulted by 2 police officers without justification(like I said I want to keep the details thin, for privacy/legal reasons). I suffered no lasting physical injuries. I am not really sure where to go with this(if anywhere). The way I view it I have 3 non-mutually exclusive options. A)File an internal affairs complaint B)Pursue a civil suit against the local government. C)Pursue a civil rights violation case with the DOJ. Like I have said before, the assault was 100% unjustified, and I have...
  • Why Amendment 40 might not be such a hot idea[Vanity]

    11/01/2006 4:39:31 PM PST · by ozoneliar · 7 replies · 267+ views
If Amendment 40 passes, it will not only impose limits on all appellate court judges. It will also require the ouster of 5 of Colorado's Supreme Court judges, that means that the next Governor will get to appoint 5 Judges. As I understand Ritter is favored to win. That means a Dem will appoint 5 of the next Supreme Court Judges.
  • Memo to Canada: Don't ape U.S. crime policy

Mandatory minimum sentencing schemes do not work, at least not if the goal is to reduce violent crime and improve public safety. In the United States we know that, because we have tried them all. Canadians may therefore be surprised to learn that their government is mimicking this failed U.S. penal model, in the name of getting tough on violent crime.
  • Prop. 90: Will Courts Have to Correct a Voter Mistake? [Judicial Tyrants Alert]

The complaints often come long and loud when courts strike down part or all of various ballot propositions after California elections because they're either unconstitutional or so vaguely written that no one can tell just what they mean. But sometimes these court actions are flat-out necessary, either to protect vital rights or to fix problems the voters never knew they were creating when they passed an initiative.
  • Federal appeals court hears voter ID case

An Indiana requirement that people show government-issued photo identification to vote is too cumbersome and unnecessary, a civil liberties attorney arguing to overturn the law told a federal appeals court panel Wednesday.
  • Oral Arguments for Indiana voter ID case[Vanity]

I just listened to the oral arguments in the Indiana voter Id Case. This is very significant as this case is the only voter ID case to reach a federal court of appeals. The Case is 'Indiana Democratic Party v. Rokita'. The Judges were: , Posner: Reagen appointee Terence T. Evans : Clintoon appointee Diane S. Sykes: 'W' appointee At least in terms of court composition we have an edge. The Judges seemed to not let the counsel for Indiana get in a word edgewise. But, the Judges seemed to question, how Indiana could prevent voter fraud, and the Democrats...
  • Washington high court OKs local limits on gun shows

OLYMPIA, Wash. -- The state Supreme Court on Thursday upheld a city's restrictions on a gun show, but dissenters said the majority's "Humpty-Dumptyism" manages to circumvent state law that forbids cities from regulating gun shows on city property. In a 6-3 ruling, the court rejected complaints that the city of Sequim on the Olympic Peninsula ruined a gun show when the police chief imposed a number of restrictions.
  • Senator [Difi] to put 'hold' on 'Gun Dealer Bill'

WASHINGTON -- Sen. Dianne Feinstein said Thursday she would block the Senate from taking up a House-passed bill that would change how the government handles gun dealer violations.

Last night I watched a tv show I haven't watched in a while: The Dead Zone. The Dead Zone is a tv show on the USA network. The basic premise of the show is that a man(Johnny Smith) acquires psychic powers, and uses them to solve crime and help people. Normally the show is very entertaining, and I enjoy it. But, last night was different. I was treated to a show replete with ugly stereotypes, Pro-Life bashing, and not to mention weak writing. Warning this will spoil the plot The episode centers around a murder, where the body of a...
  • Judge Blocks ID Law

With less than two weeks to go before the July 18 primary, a judge on Friday issued a restraining order blocking enforcement of Georgia's voter ID law. The state immediately announced its intention to appeal to the Georgia Supreme Court. Coweta's election officials greeted the news with some frustration.
  • {Legal Help Question}-VANITY

I am writing a brief for class; I'm a bit confused over the weight of authority from different federal jurisdictions. For example: For a brief to a Federal 9'th Circuit court, how persuasive is an opinion from the third. And if 'Very' how do I phrase it when citing from another circuit? I have some other questions, if anybody on the board would be willing to indulge me. But this one is pretty important.

  • Help with car purchase[VANITY]

I'm considering buying a car, but I don't want a cent of my money to, however indirectly, go to the mideast. I was looking into several alternative fuels. It seems the infrastructure to support most of these fuels is lacking. I did find one fuel--CNG compressed natural gas. It seems there are fueling stations across the country, as well home fueling options available. I was thinking of either buying a GMC Sierra, or having another American car retrofitted to use CNG. I was hoping that some members here, also sick of supporting the mideast oil structure have experience with CNG...
