I’ve spoken to a small group of reliable, formerly high-placed intelligence officials who have dropped a few interesting tidbits on me of late. Here’s my understanding, based on the discussions: It’s not true that wiretaps and/or electronic surveillance of U.S. citizens can “only” be done with a FISA (Foreign Intelligence Surveillance Act) court order. Besides the FISA court, “wiretapping” or electronic surveillance can also be done under Title III authority. The government used this authority, for example, in the Justice Department’s secret Fast and Furious “gunwalking” case. Additionally, U.S. Presidents have the power to issue secret presidential directives that can...

Many of you have asked for the status of my computer intrusion lawsuit against the federal government. On March 19, 2017, a federal judge denied the government’s motion to dismiss my computer intrusion lawsuit, and transferred the case from Washington D.C. to the Eastern District of Virginia. Below are excerpts from the judge’s opinion, which provides a good summary. UNITED STATES DISTRICT COURT FOR THE DISTRICT OF COLUMBIA MEMORANDUM OPINION, by U.S. District Judge Emmet Sullivan As an investigative reporter for CBS News, Ms. Attkisson was responsible for investigating and reporting on national news stories. Between 2011 and 2013, she...
  • Government Spooks Can Use The Mic And Camera On Trump’s Phone Even When He Thinks It Is Turned Off

After reading this article you might not ever view your electronic devices the same way again. Last year, Hollywood released a biographical political thriller based on the life of Edward Snowden that had one particularly creepy scene. In that scene, a government spook used a program to remotely activate the microphone and camera on a laptop, and by doing so he was able to watch a woman as she got undressed. Sadly, as you will see below, this kind of thing is happening constantly. Any digital device can potentially be accessed and used to spy on you even if it...

Those who suspect the worst about the Obama administration and the media won’t have their beliefs contradicted by former CBS News reporter Sharyl Attkisson’s explosive book, “Stonewalled: My Fight for Truth Against the Forces of Obstruction, Intimidation and Harassment in Obama’s Washington.” “Stonewalled,” in which Ms. Attkisson recounts the conflicts over coverage with network executives leading up to her resignation in March, snip, but eye-popping excerpts are making their way into the press and social media. The most incendiary charge: that Ms. Attkisson’s personal computer and CBS laptop were hacked after she began filing stories about Benghazi that were unflattering to...

I just filed my latest appeal to the FBI’s improper withholding of my FBI file.

You may not know it, but every American citizen–even a lowly reporter–is entitled to see his FBI file, if one exists. Under Freedom of Information (FOI) law, the government is allowed to redact bits of information from the file if it affects national security or an ongoing investigation, but the government must provide reasons for any such redactions and disclose the rest of the file. The FBI has refused to do this in my case.

Most of the information is from the FBI report. Some contextual facts and dates have been added. The Takeaways. The Players. The Timeline. From the moment that Sharyl Attkisson met a shadowy source I’ll call Big Mac, she was plunged into a nightmare involving mysterious surveillance of her computers. They met at a McDonald’s in Northern Virginia at the beginning of 2013, and the source (she dubs him Number One) warned her about the threat of government spying. During their next hamburger rendezvous, Big Mac told Attkisson, then a CBS News reporter constantly at odds with the Obama administration, that he was “shocked” and “flabbergasted” by his examination of her computer and that this was “worse than anything Nixon ever did.” Attkisson’s forthcoming...
  • Clinton widens lead in Democrat-heavy NBC-WSJ poll But that may not the full story

In focus on Full Measure this past Sunday, we heard from a polling expert who cautioned that the headline of any poll rarely tells the full story. Looking at the sample, the WSJ-NBC News poll, like many others, leaned more heavily on Democrats. If Democrats turn out in significantly greater numbers than Republicans, then the poll is likely to be most accurate. If not, then it may not be a true measure of the state of play. On the other hand, there’s little doubt that Trump’s popularity has slipped when compared to similar, previous Democrat-heavy polls. Another factor introducing possible...

I asked Clinton and Trump for interviews. So far, no luck with Clinton. However, I interviewed Donald Trump for this Sunday’s Full Measure. The interview took place back stage in Estero, Florida prior to his appearance there. My crew and I were cleared by Secret Service several hours in advance and waited in a small locker room where the interview was to take place, so we didn’t get to see the crowd as it gathered at Germain arena. After the interview, Trump asked if I’d seen the big crowd. When I told him I hadn’t, he asked me to take...

The Takeaways The FBI could not review all of the Hillary Clinton emails under investigation because: The Clintons’ Apple personal server used for Hillary Clinton work email could not be located for the FBI to examine. An Apple MacBook laptop and thumb drive that contained Hillary Clinton email archives were lost, and the FBI couldn’t examine them. 2 BlackBerry devices provided to FBI didn’t have their SIM or SD data cards. 13 Hillary Clinton personal mobile devices were lost, discarded or destroyed. Therefore, the FBI couldn’t examine them. Various server backups were deleted over time, so the FBI couldn’t examine...
  • Trump outperforming Romney by 16-points– Washington Post/ABC News poll

Democrat-heavy sample nets better news for Trump Among the same Democrat-heavy sample: 26% say they voted for Romney in 2012. 42% say they are leaning toward Trump in 2016. The following is a media news analysis Another poll; another way to spin. Earlier this week, I showed how the reporting on a Bloomberg poll could be skewed to make results look more or less positive for a given candidate. Today, we look at a Washington Post/ABC News poll that also purports to show a widening Clinton lead over Trump – by 8 points: 50% to 42%. This may well be...
  • Sharyl Attkisson Discusses DC Journalist Bureau Chief Urging Colleagues to Take Down Trump

Sharyl Attkisson was interviewed on NewsMax TV with Steve Malzberg and discussed an event she attended where a well known DC Journalist Bureau Chief urged all of the reporters in attendance to earnestly work at taking down candidate Donald Trump. When you consider the event being discussed, and further add the known hatred from a very specific Washington Bureau Chief, it stands to reason Attkisson is discussing Carl Bernstein. Bernstein previously said that all reporters have a professional journalistic responsibility to destroy the candidacy of Donald Trump. Bernstein, if you didn’t know, is a full-throated supporter of Hillary Clinton.

Sharyl Attkisson: There’s definitely tilted news coverage. I can’t imagine any objective observer who would think otherwise. And, I tell you, I was in a room of journalists in which one of them encouraged the others quite publicly to step up and do something because he said the outcome of this election was so important. And the other thing he said led me to believe and others. He was talking about journalists stepping outside of their role to make sure Donald Trump doesn’t get elected. And he received applause for that. It’s fine for the pundits to do that but...

But allowing a panic to deflect attention from the most important issues is no help either. These are Microcephaly Kids. Their Moms probably didn’t have Zika. As you can see, they’re terrific people. I want to be with them. If God were to send me one, I would probably learn to “wag more, bark less” from them. Here are some of the observations by FBI professionals who wish to remain anonymous because their opinions could affect their job prospects: Why wasn’t Clinton’s interview recorded? On May 22, 2014 the Justice Department announced a substantial change in policy “creating a presumption that FBI…agents will electronically record,” expressing a preference for video recordings over audio. “It appears to me they made a deal not to record,” says one observer, which flies in the face of the idea that Clinton was treated like anybody else. Typically it’s the U.S. Attorney’s office, not FBI agents, deciding whether charges will be filed....

Beyond the FBI Probe There were further important public issues not addressed by the FBI today. They involve public records laws and the cost borne by the public, due to Clinton’s failures. Did Clinton allegedly violate public records laws? Yes, through use of the private servers and devices, failure to maintain required public records, temporary and permanent deletion of many records, and failure to fully disclose the records when asked. Did Clinton turn over all her public work records to the State Department in 2014 when her public servers were discovered? No. Did Clinton make all of the public’s records...

It’s hard to believe, but five years after Fast and Furious, Congress is still in a pitched battle with the Obama administration over subpoenaed documents. What does the latest production of material under a federal judge’s order reveal? Justice Department emails formerly withheld under the President’s assertion of executive privilege containing quotes like these: •“We would suggest that you pull the sentence that notes how many weapons we’ve recovered. It squares poorly with how many we haven’t.” •“I think people will accuse us of playing with semantics when we say that you did not authorize Fast and Furious, but they...
