A prosecutor telling the judge that they have no idea of what is the theory of the case seems to be an invitation for the judge to share with the prosecutor a little indication of who is the boss. Pro tip to the prosecutor. It isn’t you.

Hundreds of people in the administration can issue "Classiied" information. And those same people can unclassify them. It doesn't take the President.

Which makes me think that he is not focused on convincing the trial judge. He is writing for the benefit of the appellate court or the voting public.

Prosecutors normally are not stupid enough to say things like this. Smith really lacks the temperament for the job.
I’m wondering why this judge doesn’t dismiss with prejudice, based upon what didn’t happen with Pence and Pres. Biden. Wondering if Pres. Trump’s lawyers even brought\bring this up as a reason for a dismissal
request.
This is the same prosecutor’s office that took the position that because Biden has a bad memory now he couldn’t be prosecuted for crimes he did years ago.
This is an intimidation tactic by smith, nothing more. We’ll see how effective it is.
