I would rather have a Judge rule on this.

But at the time they had to decide, the defendant and his team did not know how the prosecutors would screw up, nor how strongly the judge was going to dress them down.

A Judge is trained in the Law. I rather trust a Judge then a jury with a single “woke” moron on it.
