Fort Hood sergeant says he shot and killed armed Black Lives Matter protestor

An active-duty Army sergeant from Fort Hood says he was the one who shot and killed a man at a Black Lives Matter protest in Austin, Texas, last weekend, according to the sergeant's attorney.

Sgt. Daniel Perry said he fired at Garrett Foster out of self-defense after Foster allegedly raised an assault rifle toward Perry, according to a statement from the attorney obtained by The Washington Post.

According to the statement, Perry was driving for a ride-share company in downtown Austin on the night of July 25 when he turned a corner toward a protest he did not know was taking place.

At that point, the attorney says protesters began beating on Perry's car. Foster then allegedly approached the car window holding an assault rifle.

The attorney said that Foster gestured with the gun for the driver to roll down the window, and Perry did so because he "initially believed the person was associated with law enforcement."

Perry realized Foster was not an officer, after which Foster allegedly raised his rifle at Perry. The attorney said Perry perceived that as "a threat to his life" and fired at Foster using a handgun he kept in his car.

Police said last weekend that the shooting victim was transported to a hospital and announced dead shortly thereafter.

According to the Post, blurry cellphone footage shows protesters outside Perry's stopped car. Honking can be heard followed by gunshots, along with a woman yelling that "a car just ran over somebody."

Perry's attorney said that the Army sergeant has served in the military for eight years, including a tour in Afghanistan. He is not facing any charges at this time, the Post reported Friday.

Any DA, who tries to make one of the cases into a murder or a manslaughter case needs to be sued in civil court for personal damages and in criminal court for his/her/its unconstitutional action

Pretty sure that from 1976 on all prosecutors have absolute immunity from any lawsuit deriving from their actions as prosecutors Imbler vs Pachtman - maybe some lawyer type on here can confirm or deny this

That pic sure looks like he’s raising the rifle to a firing position, not merely carrying it. I consider that a green light to use lethal force to protect myself and others.

Hell, I’m glad he’s active duty. He’ll have LOTS of ... armed help ... if should need it.

And intelligence services to help track down any threats on him or his family...

We know from earlier photos he was carrying an AK with a folding stock. It is obviously hard to tell from the grainy photo, but it looks like he is holding the rifle in front of him, not quite at 45 degrees. The driver is sitting low in comparison, but it still isn’t pointing at him yet. Totally justified shooting, but the evidence is ambiguous enough that there may be trouble for the shooter in liberal Travis county.

What year? I can only find four ribbons that one is eligible for out of BMTS and none of them look like the one on the left, in the photo.

Heck, even here in GA, approximately 5% of the adult population has a Georgia Weapons License.

A few weeks ago we had a situation where an illegal protest / riot shut down a major intersection of two multi-lane boulevards in the City of Atlanta, enforced by goons carrying rifles. A guy caught up in traffic in the situation decided he would pause to get his AR out of the trunk. He ended up driving over the curb, on the sidewalk, maybe through a parking lot to get around the impromptu enforced George Floyd Moment of Silence that these idiots were imposing on the motoring public, and had shots fired at him/his car. No one was hit, and he didn’t return fire, but THAT could have been a complete mess.

Naturally none of this was reported in the local media, but there are multiple videos of the event still up at Twitter.
