Truckers Call for Second Amendment Right Nationwide During Emergency

A group of small business truckers has sent an email to the Department of Transportation Secretary Elaine Chao. The email asks that, as part of the national emergency involving the Chinese virus, the federal government declare the Second Amendment overrides state law and federal regulation forbidding truckers from exercising their Second Amendment rights.

The 15,000-member SBTC is calling on federal authorities to preempt state and local laws regarding the right to carry a firearm.

Therefore, in accordance with the Second Amendment to the United States Constitution, we hereby request the U.S. Department of Transportation please issue a preemption order nullifying any and all state and local laws that restrict truck drivers from carrying firearms across state lines throughout America in order to enable them to protect themselves and their cargo as they engage in interstate commerce.

As this is now a matter of life and death, please issue same forthwith.

“The SBTC through its TRUCKER LIVES MATTER campaign has sought the unfettered ability of drivers to carry firearms for self protection nationwide since its inception in 2014,” Lamb tells Transportation Nation Network (TNN).  “We have pointed to Department of Labor statistics that show the unusually high rates of murders on the road for workers in interstate transportation.”

This is a valid argument.  It is vital that trucks keep delivering everything society needs to keep operating during the emergency. During social unrest, there will always be an element attempting to take advantage of the situation.

One argument between those who want the population disarmed and those who believe the population should have easy access to arms is a small scale, utilitarian one.

People who are voluntarily unarmed have a psychological interest in promoting the idea that having a gun makes a person less safe,

The right of the people to keep and bear arms shall not be infringed.

Really? Can I take a firearm into a prison or court? Can I take it into a school, bar, sporting event, or government building in all states? Can a five year old go into a store and buy a gun? Can a mentally impaired person buy a gun in most states?

States cannot override that and be in compliance with the Constitution.

States do it all the time and the courts have upheld their right to do so.

They uphold abortion all the time, as well. That doesn’t mean it is in keeping with the Constitution.

In your opinion, as you read the Constitution, do you think it is in keeping with the Second Amendment for states to deny interstate truckers the RKBA?

Not in their home state so long as they meet state requirements. Not in other states that have reciprocity with their home state. But in other states they do so at their own peril.

But as you read the Constitution, do you think it is in keeping with the Second Amendment to forbid citizens from taking their weapons into any Capitol, state or federal? Forbid them from taking their weapons into courthouses - state for federal? Forbid them from taking their weapon into the White House? Prisons? Bars or sporting events? Can states forbid children or the insane from buying guns?

Children are not legal adults, though at most states age of consent that’s a moving target.
Insane, come on. They shouldn’t be on the street. If you cannot trust them to be on the street with a firearm, they shouldn’t be on the street.

Personal accountability. That’s what is missing. If there was PA, then yes a person should be able to carry ANYWHERE.
The white house is part personal residence, and a bar is a private establishment, so those should be clear.

If society held persons Immediately aand fully accountable, then yes. Shall not means no restrictions. And to be clear the way the FF intended “arms” meant ANY weapon. Tomcat, Abrams, MOAB. Any.

The world has not changed, the nanny state has. Society used to realize if you held everyone accountable ( no special set of rules for Anyone) then there is no need for big government.

Hit. The. Reset.

Why not? The first amendment is now gone.

A Florida asshole sheriff defending his arrest of a pastor having a service because he “violated the ORDERS from the President (not true), the Governor, the Mayor and the (get this ) CDC”.

Wow, now the CDC is our overlords and King. They give ORDERS.

Without the first amendment you damn well need the second. And IMO it’s time to use it now.

This economy cannot recover from 30 more days of arbitrary shut downs from bureaucrats that have no legal authority to do so.

One industry after another will need more bailouts. Trillions in printed money.

It’s so arbitrary I can’t go to the dentist but get an abortion. Illegal aliens are mowing lawns but hairdressers have to close.

Beyond ridiculous at this point.

The worst is coming...since or overlords are demanding only take out of delivery of food from restaurants the container manufacturers won’t be able to keep up. Probably because they are “non-essential”.

I’ll tell my kids about they Great Cardboard and Styrofoam Wars. It will be ugly. Pizza Hut fighting Papa Johns in the streets, Dominoes becoming a terrorist organization. McDonald’s forces Idaho to cede the state to them.

On the bright side the liberal loons will have to embrace paper and plastic products now to get their take out. And cloth bags are filthy and can carry the virus!

He mentioned it. States like PA and others retracted on gun shops not being essential. He’s protecting the 2nd A imo. Federal “guidelines” forced certain Governors to reopen gun stores.

He doesn’t need to be “shaken loose.” It’s happening.

OK so tell me where it reads "except for children, mentally impaired, and criminals." You say it shall not be infringed then proceed to list all the times it is infringed and you don't seem to have a problem with. So I'm not sure I'm the daft one in this discussion.

You say personal accountability is missing, and I don't disagree with you on that. But when a state decides that personal accountability should be taken into consideration and places restrictions on CCW permits in the form of background checks, training requirements, and the like you to ensure people understand their accountability then suddenly you throw a hissyfit.

Regulating who can carry outside their home is and should be a state issue. The federal government is not give that power by the Constitution so therefore the 10th Amendment applies.

The constitution applies to all men.

Children are not able bodies (and sound minds).

Mentally unstable are the same as children, not able bodied and sound minds.

One does not need a permit to authorize them to use a God given right. If you need a permit then it’s not a right, it’s a privilege.

States are not allowed to infringe upon one’s rights.

I suppose this is lost on more people than just you.

Feel free to disagree, but it doesn’t change the issue.

Your free to your own opinion, just not your own set of truths.

So you are saying that children and the mentally impaired have no Constitutional rights? I don't know many lawyers who would agree with that.

We're talking about the Constitution not the Deity.

States do it all the time. Try yelling 'fire' in a crowded theater and see where that gets you.

Congratulations!

You have come to the same conclusion many in the past have reached.

I’m glad you understand I’m in opposition to how lawyers would think. The represent the large portion of the problem. I feel my life blessed that I know very few, either personally or professionally.

The limit or lack of your faith.

You lack the will to understand what the Founding Fathers intended, not just for them and their time, no, they planned on it existing in perpetuity. for. all. time.

It does require imagination to believe that we have the ability to align ourselves, and our government to the tenets of the constitution and live in alignment with God and his plan.

The constitution should never be separated from the Deity.

It appears that I have not been able to explain with sufficient clarity to change your mind, and it should be obvious that you are not able to change mine. At least let us be amiable in agreeing to disagree.
