Trump must not cave on 'universal background checks'
Washington Examiner ^ | September 19, 2019 01:27 PM | by Brad Polumbo

President Trump's history is all over the place when it comes to the Second Amendment and gun control.

Luckily, he has so far defended the Second Amendment as president, with the notable exception of his foolish, arguably illegal bump-stock ban, which would ban a popular firearm accessory via executive fiat.

On the issue of background checks, Trump’s stance has been far from clear. He’s both opposed and vocally supported so-called “universal background checks”. Yet with Attorney General William Barr meeting with congressional Republicans to push a gun control bill expanding background checks to private gun sales, it’s more important now that Trump does not cave — and rejects background check expansion as a useless virtue-signal.

First, the vast majority of gun sales already go through background checks. Current law requires any federally-licensed firearm vendor to run a background check before completing a sale. This is why almost 90% of firearm sales involve a background check already.

The tiny minority of gun transfers that don’t require background checks are person-to-personal sales, or private sales. In many states (and for all interstate sales) background checks are also already required. But whether you want such a rule in your state or not, required background checks will not stop mass shootings.

...

Here's the issue: Democrats are hell-bent on keeping long-term records of gun purchases, and law-abiding gun-owners value their privacy. Democrats' determination to track gun owners has blocked reform proposals in the past, and it will probably continue to do so. Anyone who values the preservation of gun rights has to oppose the creation of an effective gun registry — especially with Beto O’Rourke literally saying “yes, we’re taking your guns,” and receiving enthusiastic cheers from Democratic audiences. Government tracking of guns, after all, is a necessary precursor to mass confiscation.

It amounts to gun owner registration.

For the life of my I [still] don’t understand how politicians simply bypass the Constitution——all under the guise of “for your safety”.

Facts aside, their oath is to the constitution-—polls and feelings don’t mean crap. There are ways to change it and it requires 3/4’s of the states, 2/3 of Congress and the President....just to start.

It’s time we roll back all these gun laws. Stop with these BS laws on top of thousands of other laws. It states that it shall not be infringed....period!

The only issue I have with the bump stock ban is how it was implemented.

the only issue I have with Red Flag laws is they are unconstitutional, and they WILL BE ABUSED.

The only issue I have with universal background checks...is every aspect of it. All of it.

It’s the ultimate precursor to confiscation.

This is the hill to die on folks.

[[For the life of my I [still] don’t understand how politicians simply bypass the Constitution]]

Because there aren’t enough people to seriously oppose them to stop their nonsense in it’s tracks- By all rights, people should have voted out every gun grabbin lyin constitution defying official- but they just keep electing them, they pass unconstitutional laws, and just keep getting reelected- The people in those states who are liberals want to have their constitutional rights violated- and there just aren’t enough patriots to oppose them at the polls-

we need to communicate to PDJT that he should seek repeal of all of the existing “gun laws” and disbanding of ATF (at least the firearms part, though the alcohol and tobacco parts can also go! for all the ‘good’ they do, ha!)

put the employees to work doing something useful and constructive for America.. like, say, constructing our defense wall

Between the lack of holding coup plotters accountable and the above, it's pretty obvious Barr is another Deep State operator.

Every new state drivers license/ID of a participating state and passport/passport card issue could come with a background check.

If one is OK, that fact could be indicated on the passport/passport card/state license/state ID card.

One could then buy a gun within 30 days of issue (within the state for a state ID/license) without going through the 4473 route. The dealer would simply log the ID and information onto a form. The form would have to be kept private and with the gun seller or his successor/estate for between 24 and 36 months and then destroyed, unless law enforcement provides the gun to the seller along with a signed written statement stating that a law enforcement officer believes the gun was used in a crime, which shall be retained by the form holder for at least 12 months.

The old 4473 method would remain available.

My new confidential method would allow background checks to be universally required within a participating state.

The universal background check requirement for a state would be in effect when the Department of State and state both are actively participating.

“For the life of my I [still] don’t understand how politicians simply bypass the Constitution”

Because the Supreme Court loves to misuse the Constitution itself.

If I’m not mistaken, Currently the federal and state governments are mandated to destroy a background check record within 24 hours. Clearly that law is not being honored by anybody. I hope he refuses to sign any such law but if Trump does allow a universal firearms background check law then he needs to, at the very least, demand a stringently enforced universal voter ID law in turn and void ALL motor voter laws.

Absolutely correct.

The Left is DROOLING to get a UBC. Why?
Because it is nothing less than gun registration.

Why do they want that? Because confiscation is impossible unless you know where all (or 98%) of the guns are located.

Why might they want to confiscate all or the vast majority of guns owned by average citizens? The simple answer is “Control.” Look at how much contempt they have for us now, and how they run completely roughshod over laws and the Constitution itself - when there are 500 million guns in this country. What could they be planning that would require us to be disarmed? Again, control - control like the KGB and the Stasi could have only dreamed, due to the ubiquity of cameras, location technology and the permanent nature of everything said or written that is communicated via electronic means. Once they have that degree of control and a guarantee that no one could possibly put up serious opposition, they will do ANYTHING that they can dream of, whenever the mood strikes them - and no one will be able to stop them. That is their goal.

If the UBC is passed, we are not merely going down a slippery slope, we’ll be nearly at the bottom. We must stop this thing dead in its tracks, or we’re done...and it won’t matter if Trump wins, because at best that’ll buy us 4 years of relative peace and respite. Sooner or later, we will have a Dem President, Dem Senate and Dem House - and if we have the UBC at that point, confiscation will follow within a year or 2 at most. Stop UBC now, and we have a chance for many millions of guns to go “off paper” (or not even get on paper to begin with - 80% receivers). That’ll give us a fighting chance.

That’s why it has gotten so incredibly nasty. Trump wasn’t supposed to win - which would have allowed Hillary to appoint the 2 that Trump appointed already, plus Ginsberg’s and Breyer’s replacements. That would have forever (”forever” as in for the remainder of the Republic’s very short existence) changed the composition of the Court to reflexively anti-gun and anti-liberty. Now, however, with Trump appointing so many Circuit Court judges and 2 Justices (so far, with 2 more likely soon), that dream of theirs is being destroyed, perhaps forever. A USSC with 2 more Constitutionalists on it could sweep away the 1934 NFA and most state gun laws with a single ruling. Do that, and gun control is DEAD - as is the Leftist dream of imposing their rule over us (they’ve tried persuasion, and we simply weren’t buying what they were selling, nor will we ever do so).

The bottom line is that a background check would not have stopped any shooting I remember. What would be effective would be preventing convicted criminals from ever possessing guns, committing the mentally ill to hospitalization and/or monitoring, and allowing stop and frisk in inner cities.

Something like 90% of our shootings happen in a few areas and by repeat criminals. Control that and you’ve controlled gun violence.

But that’s not what socialists really want. They want to control your life and your death. They can’t do that if you can fight back.

Too much more at stake if socialism wins. I think we should at least make them battle for each inch of ground gained.

We will have lost one, but we never give up

The Constitution means nothing.

The Kenyanesian Usurpation proved that.
