Opinion: How the courts can help in the climate change fight

A Quebec environmental group is taking the federal government to court. ENvironnement JEUnesse filed a class-action suit on behalf of Quebeckers aged 35 and under seeking a declaration that the government’s behaviour in the fight against climate change infringes on their human rights. The claim also seeks punitive damages.

They are not alone. Similar claims have been filed on behalf of young people in other jurisdictions, including the Netherlands, the United States and Colombia.

Understanding and addressing the challenges of climate change is rapidly becoming the next legal frontier. As environmental lawyer David Boyd recently noted, litigation is one of the most powerful tools for holding governments’ feet to the fire and demanding accountability.

It is no wonder that courts have become a popular venue for achieving policy ends. This is a default response to thin political markets where the rules that emerge from the political process tend to focus on short-term outcomes and favour those with the strongest commercial interest in a particular policy outcome.

Issues arise as to the impact of such judicialization on democratic accountability. Judges are not elected, and judicial activism can become self-reinforcing. Activist positions generate precedents and the legal basis for intervention in other areas. To the extent judicial activism is grounded in international standards this concern is lessened. Relevant standards include the Paris Agreement, as well as the Sustainable Development Goals (SDGs) adopted by 193 countries in 2015.

Just as courts have historically stepped in to protect minority rights, they are likely to enforce societal rights – by aggressively refining our understanding of the obligations of the state and private actors to address fundamental governance misalignments between risk-taking private interests and the public interest in controlling systemic harms.

Man that is one wordy, high sounding, ostentatiously superficial way of stating that the peoples reps are too stupid to know what’s best for society that the courts therefor should overrule their ignorance and legislate from the bench.

This lawyer might be on to something. Could this tactic be used against our Congress as they fail to follow up on their promises? Such as when they promised to build the wall decades ago? Or when they say that you can keep your own doctor and that health care premiums would be no more than $2,500/year?

How many are old enough to remember the halcyon days before all the endless public pearl-clutching about phony “climate change”?

Or, for that matter, the endless nattering about health care, evil white people, the evils of Western Civilization, and abortion. We expected and got the peaceful transition of power in Washington every four or eight years. Democrats weren’t a communist front group.

Life was simply so much better four or five decades ago.

Over human history people have almost always blamed some poor scapegoats for bad (cold) weather and crop failure. The scapegoats were murdered in various awful manners generally under some form of government or community authority. Human nature and sophistication has not improved one iota in the last 5,000 years since the dawn of civilization.

The 3600 signature cycle continues to unfold. Such as floods, earthquakes, volcanic eruptions, bugs and pests as well as crazy unseasonable weather patterns. And the chances for humans to stop or avert any of this are pretty slim to none as this appears to be a re-occurring natural event or cycle. And even if all the politicians stand on their heads, as well as throwing money at what is conceived erroneously as a problem created by humans, what it is not, it would not change a thing.

Just take the ever increasing number of earthquakes worldwide, which are part of this repetitive cycle, even in the wildest imagination it would be difficult to make a correlation between it and anything related to global warming. At least for now and until the general public becomes knowledgably enough and realizes what the real causes are behind some of these events, ignorant politicians will milk these perceived causes for climate change or global warming for all its worth, in order to extract more taxes from the general public under the guise to fight man made global warming or climate change. Humans could not do anything about it one way or another even if they tried.

More signs and events of things to come are part of the 3600 signature cycle as it is unfolding world wide. About 3600 plus or minus years ago similar events gave the then ancient Egyptian Pharaoh Thutmose an Excedrin headache and just about drove him bananas, better known as the TEN PLAGUES, eventually resulting in the release or expulsion of the Israelis from bondage as they, or good old MOSES used these events to their advantage by threatening that there would be more to come unless they would be released.
This event went down in history as the Biblical EXODUS. The catch is that these events were not just limited to ancient Egypt at the time, as we scan ancient, available and somewhat scarce records from this period we will find that ancient China was plagued with very similar events and disasters. On top of it we are also entering another Grand Minimum Solar (GMS) cycle what may compound some of these strange events, and I would not be surprised if this 3600 signature cycle also has a bearing on the GMS, but that is just my thought.

Just for interest sake about the same time 1500 BC or approximately close to 3600 years ago,1500 BC + 2018 AD= 3518 approx.the time of the EXODUS the volcano located on the island of Thera located in the Mediterranean blew up with the estimated force of about 40 (forty) nuclear bombs, permanently re-arranging the Mediterranean, forming the Santorini Archipelago. At the time turning days into night, also affecting Egypt with pumice from the eruption found there as well.

So far being located in the Midwest, overall we have remained pretty well unscathed aside from some flooding here and there. Lets hope it remains this way.

For someone who never heard of this it may elicit a smile, on the other hand you may want to keep in mind that there has been a steady increase in earthquakes, volcanic eruptions, flooding all over as well as one season running into one another along with crazy weather patterns worldwide. All this just doesn’t happen without a reason and global warming supposedly caused by humans is not one of them

I think it is past time for life-time appointments of judges. The judiciary everywhere needs to be reined in and lassoed.
