Judge Andrew Napolitano: Why I am so deeply disappointed by Trump's Supreme Court pick.

When Donald Trump started running for the Republican nomination for president in June 2015, he began by attacking the Republican establishment in Washington, and he began his attack by calling the establishment "the swamp."

His real target was the permanent government and its enablers in the legal, financial, diplomatic and intelligence communities in Washington. These entities hover around power centers no matter which party is in power. Beneath the swamp, Trump argued, lies the deep state. This is a loose collection of career government officials who operate outside ordinary legal and constitutional frameworks and use the levers of government power to favor their own, affect public policy and stay in power. Though I did not vote for Trump -- I voted for the Libertarian candidate -- a part of me rejoiced at his election because I accepted his often repeated words that he would be a stumbling block to the deep state and he'd drain the swamp.

On Monday night, he rewarded the swamp denizens and deep state outliers by nominating one of their own to the Supreme Court.

I understand his concern. I hope he is wrong. I remember when Kennedy was chosen - the Republicans were politically motivated to confirm a judge after Bork was “Borked”, and we got Kennedy. Same with Souter and others. Perhaps Kavanaugh will turn out as we hoped, but until he is confirmed, we will not truly know. In that regards, Eddie Munster is right.

Thomas is going to retire

Are you just speculating or has Thomas spoken about retiring within the next 2 years? He's 70, which isn't exactly young, but unless he has some health problems that I'm not aware of, my guess would be that he could probably count on another decade on the bench.

The big swing on the court will happen when one of the geezer lefties gets replaced. Kavanaugh is ok as we await that monumental event.

One reason Napolitano doesn’t like Kavanaugh is that Kavanaugh believes in the Bible whereas Napolitano is a homosexual.

Since I heard Napolitano say this I am now 100% behind this candidate. I think this judge has problems.

I feel the same way about Nappy. He's always wrong. It's like when Dick Morris was still a 'thing'. Every time he made a prediction I expected the opposite to happen. You could have made book on it.

Napolitano hasn’t been right in the head since he was suspended and was taken to the wood shed by the boys at FOX. He must have taken a lot of hits to the head with their rubber chickens.

Kavanaugh was not my first choice, but after listening to the far left getting more and more hysterical I feel a lot better about him.

The bottom line is that there are only 51 Republicans in the Senate. McCain is home dying so that leaves 50. At least 2 or 3 of the remaining 50 are squishy RINOs. Kavanaugh was probably the only conservative pick that Trump could make that all 50 would vote for.

Hopefully, the Republicans will pick up some more Senate seats in November (there are 10 Democrats running for re-election this year in states that went heavily for Trump). Trump can then pick the most conservative qualified candidates for the next openings without caring about getting any votes from the moderates and liberals.

Assuming that the Republicans hold the Senate, then Thomas will retire next summer. He does not want to risk a Democrat becoming President in 2020 and having to stick around another 4 or 8 years or more.

Ginsburg (who did not retire when she turned 80 back in 2014 because she was sure that Hillary would win and that the Democrats would retake the Senate in 2016) is stuck until at least 2020 and hopefully 2024 and beyond. She is far more likely to die while Trump is still in office than she is to make it until a Democrat President and Senate can replace her.

“Napolitano’s longtime friend James C. Sheil died on March 19, 2013. In the Acknowledgements section of his book Suicide Pact: The Radical Expansion of Presidential Powers and the Lethal Threat to American Liberty, Napolitano states: “... my happy dreams turned dark last year when Jim Sheil, my alter ego to whose memory this book is dedicated, died suddenly on March 19th 2013, as we were working on this book. Jim and I shared much of our lives with each other. Among that which we shared was a love of the printed word. Yet our philosophies and politics were like oil and water.””

So are we to conclude that Napolitano is gay? It would be a reason why he’s where he is with the Colorado baker.

Bill Kristol is an even better example of a full-of-himself, self-proclaimed prognosticator whose predictions are virtually never correct, even by accident.

Thomas has stated on several occasions that he wants to actually enjoy his golden years and doesn't plan to stay on the court so long they have to take him straight to the care home upon retirement. In fact as far back as 2005 there were rumors that he was seriously considering stepping down. However, when the democrats took over the Senate in 2006 and then Obama won in 2008, he decided to stick it out until a Republican was back in office. Which is why it's a bit surprising that he hasn't retired already. Most court observers believe he is trying to wait a year after Kennedy to minimize the disruption to the court. Of course that's a risky strategy because if democrats take over the senate in November, he could be stuck on the court for another decade.

The Supreme Court has four who are weak on the Constitution and follow the dictates of Social Justice.

If Kavanaugh can read and understand Constitutional Law, the better for America and the original intent. Just remember Judge Roberts and his beatific smile....his overreach on Obamacare as a tax rather than unconstitutional only proves....no one elected to the SC is perfect.
