Ohio teens given suspended sentence for dropping sandbag off overpass that killed man

The four Ohio teens who pleaded guilty to dropping a sandbag off a freeway overpass that killed a 22-year-old man were given a suspended sentence and ordered to a treatment center on Friday.

Marquis Byrd was the passenger in a vehicle that was hit by the sandbag dropped onto Interstate 75 in Toledo last December. Byrd was left in critical condition and died three days later in the hospital.

The four teens, all aged 13 or 14, pleaded guilty to either murder or manslaughter. The boy who dropped the sandbag pleaded guilty to murder while the other three pleaded to involuntary manslaughter, the Toledo Blade reported. The teen who pleaded guilty to murder was sentenced to the Department of Youth Services until he turns 21, while the teens who pleaded guilty to manslaughter were sentenced to three years in the Department of Youth Services.

All four sentences were suspended by the judge in favor of being sent to Toledo's Lucas County Youth Treatment Center.

"It's a treatment facility, for certain services, to provide so these boys change their behavior and can become productive members of our community," Judge Denise Navarre Cubbon said.

The decision to suspend the teens' sentences and send them to the treatment facility drew outrage from Lillian Diallo, the Byrd family's lawyer, who called the decision "outrageous."

"Suspended what? If you do what? So eight months you get to go home?" Diallo told Toledo ABC station WTVG outside the courtroom following the sentencing. "This child will never be at home. His son will never see him. His mother will never be able to say, 'Hey son, how are you? How's your day?' Touch his face, see his face. This is outrageous."

Second degre murder is like coming home and your wife is in bed with the local hockey team and you grab your pistol and kill them spur of the moment

Maslaughter has degrees

These kids were young

Despite freeper anger I don’t think we execute 13 or 14 year olds

The judge was disappointed that these teens only killed one Black man. She’s sending them back into the community to kill more.

They should be in jail, or better yet taken out and executed. I’m sure this won’t be the last time they’re in trouble otherwise. How many more people need to be injured or killed by their actions? Further, their parents should be in jail too.

You have to prove they knew or intended to kill

If not then second degree at most or more likely manslaughter of the highest level

That’s just the laws

If you think they are soft then work to change them...no offense...I usually agree with you

I agree the bag dropper should have gone to reform school

I don’t think he should have been executed

Things are not always simple and easily punished

I gotcha.

What threw me is that the ninety percent of metaphoric racists in the Freeper community turned out to have been right in their assumption.

I reckon I’m too hasty about that stuff too, but I can’t remember the last time I saw the word “teens” used in a headline to describe white miscreants.

Yes they indeed do have various reform schools

In tennessee you start at a managed home for borderline bad kids

Then if that fails county juvenile facility

After that state Boys Ranch.....rougher

If that fails or if crime serious enough you go to juvenile quarters at State Prison....near Riverbend

Or if mental you go to mental facilities

Whee i grew up in Mississippi

First stop maybe French Camp a tough boarding school that took problem kids

You went to Oakley county training school...a farm

Then Columbia Reform School..tough

Last stop was Parchman Farm ....our version of Angola

My first cousin managed to work his way up through all of them

Became an armed full leg trustee on horseback at Parchman

Lived at Trustee camp where booze and women were allowed on weekends and you had a full pass pickup for errands off grounds

He loved it....three square and a cot and medical and poontang....
Former Vietnam war green beret...nobody messed with him much there

Big joint.....almost 20,000 acres

I think I was wrong...I thought I saw a pic of four young boys and they were white. I’m not certain though.
