... The U.S. Supreme Court on Monday rejected the last-ditch plea by Arizona Attorney General Mark Brnovich to uphold a 2012 executive order by then-Gov. Jan Brewer to deny drivers licenses to DACA recipients, an order current Gov. Doug Ducey has left in place.

It was shortly after Obamas action that Brewer directed the Arizona Department of Transportation to deny licenses to DACA recipients.
She cited a 1996 Arizona law that says
state licenses are available only to those whose presence in this country is authorized by federal law.
Obviously, they trampled all over the Tenth Amendment, she said, citing the amendment that says powers not delegated to the United States by the Constitution are reserved to the states respectively, or to the people.
She called DACA an illegal Obama executive action that trumped states rights. ...
Brewer argued thatthe U.S. Department of Homeland Security has no legal authority to permit DACA recipients to remain and work.
... Brewer said Mondays ruling leaves two options going forward.
One is for Trump to rescind DACA, something the president has tried to do.
But those efforts have so far been blocked by a federal judge.
The Supreme Court has declined to intercede,meaning there will be no final decision before at least this fall.
The other, said Brewer, is for Congress to finally address the question, in statute, of whether DACA recipients should be allowed to stay.
That would not only make moot any questionof whether they are authorized to be here
but make it clear that they are entitled to the same rights and privileges, such as licenses, as other legal residents who are not citizens.

From the above article:
“The San Francisco-based 9th U.S. Circuit Court of Appeals last year struck down the Arizona policy, ruling that the state cannot develop its own definition of immigrants who are authorized to be in the United States and that only the federal government had that power.”
There is a bigger play here. The Ninth Circus says that “only the federal government had that power.” Think California. Think Sanctuary cities. The Ninth Circus just hung California and the Trump Administration (Sessions) will take that every time. This is precedent from the “local” circuit. California doesn’t have a chance now.

I would redefine the jurisdiction of the current 9th to all cases occurring on the territory directly UNDER the current court house building. Then I would create two new districts from the remaining territory and nominate normal judges to to carry on.

We wont miss the press conference.
Heres Jeffrey Lord making an argument about how Trump could proceed here after the Ninth Circus continued the stay on his executive order.
LORD: Newt Gingrich when he was running for president in 2011, talking about the Hamdan v. Rumsfeld case involving Guantanamo and the rights of prisoners.
And Speaker Gingrich said, I would instruct the national security officials in the Gingrich administration to ignore the recent decisions of the Supreme Court on national security matters,
and I would interpose the presidency in saying, As the commander-in-chief, we will not enforce this.'
This is called departmentalism.
And this goes back to Thomas Jefferson, who wrote in 1819, Each department of the national government is truly independent of the others
and has an equal right to decide for itself the meaning of the Constitution in the cases submitted to its action.
RUSH: Okay, were you following that ?
Now, this is an admitted Trump supporter, Jeffrey Lord.
He writes for the American Spectator, and hes citing actual and true American history.
Hes reciting what Jefferson wrote, and he is quoting Newt Gingrich.
Now, hes talking to Jeffrey Toobin.
Hes a legal analyst [for] CNN.
As far as these people are concerned, there is no coequal branch business.
The judiciary runs this country.
Yes, theres separation of powers, but whenever a court speaks whether they are condemning the constitutionality of a law from Congress
or whether they are condemning a presidential action
the Supreme Court is it.
The Supreme Court is the last word.
Here comes Jeffrey Lord saying (summarized), No, no, no.
Thomas Jefferson said its up to each branch to decide how in the world they are going to define the Constitutions separation of powers,
and he quoted Gingrich as saying (summarized), Look, in matters of national security, the court can go to hell.
Im gonna ignore what the court gets wrong because they dont have all the information I have
and Im gonna implement what I think best.
Well, now, you can imagine the reaction this got on CNN.
TOOBIN: God sakes, Jeff
LORD: Well
TOOBIN: thats ridiculous.
LORD: Well
TOOBIN: The idea
LORD: Jeff
TOOBIN: that the president of the United States can ignore judgments of the court?
You know, Andrew Jackson did it regarding the Cherokee Indians. LORD: And Abraham Lincoln did it!
Abraham Lincoln did it.

TOOBIN: Yeah, Abraham Lincoln did it during the Civil War
WOMAN: (snickering)
TOOBIN: which is a little different from whats going on now.

By the way, Lincoln did more than what Jeffrey Lord is attributing to him. Abraham Lincoln actually put a sitting member of Congress in jail.
He sent the military out to roust the guy up, put him in jail.
Roger Taney was a chief justice of the Supreme Court and he gave a ruling that Lincoln didnt like on habeas corpus, and he almost put Taney in jail.
The fact it was a Civil War
You know, folks, I gotta tell you something.
I dont think were that far from a Civil War in this country right now.
Im not talking about armed conflict, North v. South,
but we clearly have a divide in this country that is in no way gonna be bridged.
It isnt gonna be bridged by compromise.
Its not gonna be bridged by walking across the aisle and getting along with people,
and its not gonna be bridged by persuading people to agree with us and vice-versa.
The only way this is ever gonna end is when one side gets defeated politically defeated and becomes a demonstrable minority.
Thats the only way any of this is gonna end.
The left does not want this to end !
This is normalcy for the left.
You must understand this.
This is what they want life in America to be day in and day out.
Remember, they are victims.
They are not happy.
As victims, it is impossible to be happy.
Its impossible to be content.
They think there are no reasons to be happy.
Even when Obama was winning and he was in the White House, they were still livid and angry every day !
Over what ? The fact that there was opposition to Obama !
They werent even happy when he won.
They would not have been happy had Hillary won, because there would have been opposition.
And they cant stand opposition.
They dont think opposition is warranted or justified.
So there is no common ground between the divide, the divisions in this country.
In that sense, there already is a civil war. Im not talking about armed conflict.
Im talking about a battle.
How does it end ? Are you gonna persuade the libs in your neighborhood, do you think ?
You think theyre gonna persuade you ?
It isnt gonna happen, not en masse.
I mean, you might randomly influence somebody at the Chamber of Commerce, at the Rotary Club or whatever.
But en masse, it isnt gonna happen.
And they sure as hell, folks, are not gonna persuade me.
There is no way under the sun that I being of conscious, sound mind and body
will ever agree with liberalism about much of anything.
It isnt gonna happen.
And Im not alone in that.
So what is the solution to this ?
We just go on like this ?
Because thats whats gonna happen. The left, this is what energizes them.
This is what gives them their meaning in life !
This is what gives them a reason to get up every day, as long as somebody else is paying them.As long as somebodys providing them food stamps,
as long as somebodys giving em health care,
as long as they do not have to work in order to live,
this is how they want to conduct their day: Causing trouble, raising hell, opposing everything they resent that is characterized or classified as normal.
They are enraged and angry throughout the day and night, and they have been my entire life.
Its intensified with every year of my life.
This is what life in America is gonna be until one side loses and concedes and surrenders.
Now, you tell me which sides it gonna be ?And you look at the onslaught and you look at every direction they are coming at us from.
Every issue that they supposedly have is nothing more than a trick and a disguised effort to advance their agenda.
I dont care if its judicial activism, if its climate change, civil rights, equal rights, pro-life, abortion, pro-choice, what have you, funding Planned Parenthood,
its all about advancing their agenda and eliminating us.
Its not really about climate change.
They succeed in making their brain-dead rank-and-file think that the world will not be habitable in 30 years,
but its a crock.
You tell me where the agreements gonna be.
You tell me where the compromise is gonna be.
Theyre not gonna stop until they destroy the Catholic Church.
Theyre not gonna stop until the Catholic Church becomes pro-choice.
You think thats ever gonna happen ?
You think the Catholic Church will ever sanction gay marriage with openly gay priests and lesbian nuns, you think theyll openly sanction that ?
Because theyre not gonna stop until they get that, one way or the other.
Do you think thatll ever happen ?
We have the most socialist pope that weve had in our lifetimes right now.
The Catholic Church is closer to this precipice, my observation, than its been in a long time.
But to say that the very things that define Catholicism and Christianity, theyre all under assault.
Every damned institution, the Boy Scouts, the Girl Scouts, the Cub Scouts, candy stripers, nothings safe.
How does this get resolved ?
So here you have Jeffrey Lord pointing out, Well, you know, the president can just ignore it.

This arrogant, condescending attitude they bring to this stuff, when in fact American history is replete.
How come the judiciary gets to ignore, how come the judiciary gets to tell the president to go to hell, but when the president tells the judiciary to go to hell, somehow were all going to hell ?
The judiciary can do whatever they want as far as Jeffrey Toobins concerned, as far as every liberal is concerned, any liberal court can tell everybody whatever is perfectly fine, and you cant argue with it,
And let a president say, I dont believe em.
Im not gonna obey, the hell with it
and you would think itd be the end of civilization.
So how does resolve itself, my good friends ?

And it is also now four judges who have reviewed this two George W. Bush appointees, two Democratic appointees
and all four have ruled against.
The Trump administration now has two options. One is go to whats called an zen banc, more judges on the Ninth Circuit it would be 11 judges to hear the case
or go directly to the Supreme Court to challenge this stay.
RUSH: Thats not gonna happen til Gorsuch is confirmed.
And thats not gonna be the smooth sailing everybodys telling you it is.
He may end up being confirmed, but its not gonna be smooth.
Theyre just telling you, Oh, yeah, this guys so brilliant.
Theres no way, we cant stand in the way of this guy.

Now, heres Dershowitz.
Dershowitz, law professor emeritus, well-known left-wing legal scholar from Hartford also on Anderson Cooper last night. Question: Professor Dershowitz, you said theres actually a third option the president has here.
DERSHOWITZ: Third option is for the president to realize hes not gonna win on this stay issue.
He may win three months from now, four months from now,
but he has said on camera that this decision poses a grave threat to the national security of the United States.
So his option is very simple: Withdraw the current order that is subject to the stay,
write a new order with the help of his new attorney general, national security people, that will survive constitutional attack.
RUSH: Ah. Very interesting.
Is that possible ?
Is there a way to survive ?
Cause its not constitutional attack.
It is liberal attack.
This is whats happening. Oh, I know it looks like its a constitutional attack because of the way the judges talk and the way the judges write. But, Rush, how can it be liberalism when two of these judges are George W. Bush
its establishment versus outsider, liberal versus conservative, you name it.
Trump is the object of scorn, and he could write the perfect executive order.
These guys have already ignored the law once.
Theyve ignored that statute which is as crystal clear as two plus two equals four.
Theyve ignored that to stay this executive order.
You think they wont just find another reason and be able to couch it in some legal mumbo jumbo to suggest that its unconstitutional ?

One more Dershowitz, then we have to go to the time-out.
He continued and concluded, actually, with this.
DERSHOWITZ: Theres another way that he can do it, too.
He can leave this order in effect, leave it subject to a stay, and then issue a new order which supplements the order.
That way he protects his ego, he doesnt have to say, He just says, Look, theres a stay in effect.
Im now gonna issue a new order, and that new order applies only to A, B, C.
RUSH: Now, there are areas here that gave it trouble.I mean, issuing this blanket ban on entry to people that had already passed muster and were green card holders,
I mean, hes well within his rights to do it,
but that was gonna present problems from the get-go,
and they did this with no advance warning so as to prevent whats happening now.
Whats happening now is that were being flooded by refugees from these seven countries
and even Bashar al-Assad, the evil foreign from Syria, is saying, I know some terrorists from here are getting into the United States now.
There have to be.
The law of averages.
Some of the people youre letting in are terrorists.

At last count, there were about 30,000 DACA recipients in Arizona.
ADOT does not have current figures on how many were issued licenses while the case was pending.
The last update, in April 2016, showed more than 21,000 DACA recipients with drivers licenses.

This is so fed. For the local school district I am having the hardest time proving I legally live in the district because I live in a family owned home with utilities paid by a trust. I have to get a lawyers note. Why cant I just say hey, Im a dreamer, we dont need no stinking proof? This state PREFERS illegals to citizens.
