Trump’s lawyer: Presidents cannot obstruct justice

A lawyer for President Trump who admitted writing an eyebrow-raising tweet about former national security adviser Michael Flynn said a commander in chief cannot obstruct justice.

The “president cannot obstruct justice because he is the chief law enforcement officer under [the Constitution’s Article II] and has every right to express his view of any case,” John Dowd, Trump’s personal lawyer, told Axios.

He told the website he wrote a tweet posted on Trump’s personal account on Saturday that acknowledged the president knew Flynn had lied to the FBI when he asked former FBI Director James Comey to lay off investigating him.

“I had to fire General Flynn because he lied to the Vice President and the FBI. He has pled guilty to those lies. It is a shame because his actions during the transition were lawful. There was nothing to hide! ,” the tweet said.

Dowd said the posting did not provide evidence of White House obstruction.

“The tweet did not admit obstruction. That is an ignorant and arrogant assertion,” he said.

B ut the tweet immediately raised questions about when Trump knew about Flynn’s lying.

Rep. Adam Schiff (D-Calif.) said the message, not the author, is the troubling part of the tweet.

All weekend I saw lefties saying this proves it. I’m not dense but I don;t see that at all. Not even a basis for it.

Ah, the ol’ , “what did you know and when did you know it” card. :)

Except it was a tweet. Even if an obstruction case were possible, Trump could simply say that his tweet was based on current knowledge. i.e. he fired Flynn for lying to the VP and we’ve since learned that he lied to the FBI. At least he’s pleading guilty to that particular parking ticket.

Think about it this way ...

Even if it would have been a case of obstruction of justice for President Trump to fire Comey to stop an investigation, a prosecutor can only make this case by proving the state of Trump's mind when he fired Comey. The prosecutor can't possibly do this without first interviewing Trump himself.
