"So, you want the military to carry through ILLEGAL orders given by a president?

Well, we just lived through 8-years an illegal President giving many illegal orders. ("illegal"="unconstitutional").

In terms of the President's Constitutional responsibilities, the question here comes down to whether he determines, with clear evidence, that NK must be preempted.

The troll neverTrumpers here and the demoncrats everywhere are trying to imply DT would OR could nuke NK on a whim. Sheer BS.

The only legitimate "whim" target for a nuke might be DC.

Reacting badly to badly written headlines is a staple of FR. And yes, cbs is trying it’s best to divide the USA. They took the last election as a personal loss to their pc vision. The main stream media will be working overtime for the next 3 years trying to regain their relevancy. Journalism is dead - long live journalism.

“bullshit, you are wrong wrong wrong, no order is presumptively legal.”

BS to you. All orders are presumptively legal, otherwise every order would have to come with an explanation of the lawful authority for the order.

Subordinate: “You want me to do what? Well, just prove that’s a lawful order!”

Superior: “I don’t need to. You can think about it in Leavenworth, and I’ll find someone else to carry out my
orders.”

“I know there are former missile commanders here who will confirm that they and their deputy carry sidearms while on duty in the remote case that he/she refuses to obey authenticated orders.”

That’d be funning you. Shooting the other guy would make no difference to being able to launch. They were for protection while visitors were present and not to shoot the other guy. Shooting the other guy was a War Games movie scene that was pure fantasy.

This General should be fired right now for insubordination.

Maybe you should read the actual article rather than cast an ignorant judgment based on the headline.........sheesh!

Here, I'll post a copy of what I posted in #112.......

"I provide advice to the president, he will tell me what to do," Hyten added. "And if it's illegal, guess what's going to happen? I'm going to say, 'Mr. President, that's illegal.' And guess what he's going to do? He's going to say, 'What would be legal?' And we'll come up with options, with a mix of capabilities to respond to whatever the situation is, and that's the way it works. It's not that complicated."

.....LOL!

The stupid keeps getting thicker and thicker around here..........

“The General WAS stupid to answer the way he did. He was stupid to talk to CBS at all. He should be relieved. Because he is stupid.”

Totally agree. I have no doubt he knew he was feeding the anti-Trump propaganda machine. He should be fired immediately.

You are spot on, this “General” is an idiot, he needs to go.

Trump has wasted a year in not going after ALL Obama appointees in the civil service and not replacing all Obama generals and military high command that were promoted by him.

Don’t have time to read half the crap posted here - and it is crap BTW.

Consider yourself lucky that I gave you attention, but don’t think your opinion matters to me though because it doesn’t.

“All orders are presumptively legal...”

So...when I was ordered to falsify official documents, was that presumptively legal?

There is a reason why I and others like me were required to review the laws of armed conflict on a regular basis. There is a reason why I’ve sat in an exercise and listened to a 3-star general discuss the legality of certain options with the staff lawyers.

There is a reason I was told in OTS that I must not obey orders blindly.

Nothing blind about my assessment. It’s guided by 28 years in uniform and another 8 of civilian service, 4 years teaching contingency and war planning at Air University and completion of Air Command and Staff College & War College.

Stupid can mean a lack of intellectual capacity. I grant you that probably doesn’t apply to a four star Air Force General. But let’s try some other synonyms. How about foolish? Naive? Ignorant?

How could he not know where CBS was going with that line of questioning. It was ill-advised to give the interview to begin with and he should have rejected the hypothetical outright.

He was naive to think that his interlocutor was interested in a sincere discussion. It was a set up, he should have known that, and he fed into the narrative that POTUS is lawless and unstable.

Reading the actual articles before posting an irresponsible comment will help prevent you from appearing to be an ignorant moron.

You are right, not only am I lucky for your attention but hopefully you learned a lesson as well........Funny how things work out isn't it?

The context of the question was clearly political. You know it. Obviously your hatred of Trump and loyalty to the institution you served is blinding you. The good General poorly served his CINC and everyone without bias can see it.

Then why is he entertaining a hypothetical question in a public forum then gives an answer that undermines our national security?

You don’t understand the word ‘presumptively’ since you asked that question.

I understand presumptively. It does NOT mean, “The guy above you gets to say what is legal or not”. That decision remains with the person who obeys - or refuses to obey - any given order.
