Video shows Utah nurse screaming, being dragged into police car...

A nurse says she was assaulted and illegally arrested by a Salt Lake City police detective for following a hospital policy that does not allow blood draws from unconscious patients.

Footage from University Hospital and officer body cameras shows Detective Jeff Payne and nurse Alex Wubbels in a standoff over whether the policeman should be allowed to get a blood sample from a patient who had been injured in a July 26 collision in northern Utah that left another driver dead.

Wubbels says blood cannot be taken from an unconscious patient unless the patient is under arrest, unless there is a warrant allowing the draw or unless the patient consents. The detective acknowledges in the footage that none of those requirements is in place, but he insists that he has the authority to obtain the draw, according to the footage.

You do know there is a video of the crash? The cops were chasing a pickup, the pickup swerved into the truck driver who was in the right hand lane going on the opposite direction. If the cops had probable cause they can get a warrant

Should “hospital policy” trump the needs of law enforcement?

Should the nurse lose her license because an out of control cop who didn't know his department's own procedures OR THE LAW?

I don't think she should, and she did the right thing refusing an illegal directive by a rogue cop.

If a patient arrives in the ER unconscious, a blood draw is just one test to assess the reason for this patient’s state of consciousness?

It's one way, yes. That doesn't mean it gets turned over to law enforcement without a warrant.

Lawsuits do nothing. The taxpayers will pay for this. They always pay for this, and the cops either keep their jobs, or get desk duty at the same pay, or they go to another police department.

The court decision cited by the nurse regarding implied consent is irrelevant. The other case involved neither unconscious patients nor commercial drivers. The only thing that matters is if the search is unreasonable. Would taking blood from an unconscious hospital patient be considered an unreasonable search by the court? If a person’s licensed profession requires him/her to submit to a blood test after a fatal accident, does that person have any expectation of privacy that would prohibit the police from taking a blood sample after that person is involved in a fatal accident? Maybe a court would rule it unreasonable, but I doubt it. Either way, it’s not up to a nurse to decide.

It is you who is not paying attention. There is dashcam video of the wreck, linked right here in this thread.

The fleeing suspect is clearly at fault. The comatose truck driver in the burn unit is not. The main story linked in this thread clearly states this as well, if you'd bothered to read the whole thing.
