Video shows Utah nurse screaming, being dragged into police car...

A nurse says she was assaulted and illegally arrested by a Salt Lake City police detective for following a hospital policy that does not allow blood draws from unconscious patients.

Footage from University Hospital and officer body cameras shows Detective Jeff Payne and nurse Alex Wubbels in a standoff over whether the policeman should be allowed to get a blood sample from a patient who had been injured in a July 26 collision in northern Utah that left another driver dead.

Wubbels says blood cannot be taken from an unconscious patient unless the patient is under arrest, unless there is a warrant allowing the draw or unless the patient consents. The detective acknowledges in the footage that none of those requirements is in place, but he insists that he has the authority to obtain the draw, according to the footage.

It’s not “Absolutely 100% false” because I have seen it done first-hand.

Also, the hospital in the video had a policy that was signed off on by the local police department.

They cited a law that had been off the books for TEN YEARS..............

Nope.. she was correct. That cop is proof of .. LEO’S not knowing the law, or disregrading the law.
Decades in healthcare and couldn’t count the number of blood draws. Any patient refusing a draw is granted that right.
Glad she stood her ground to expose the sheer ignorance or disregard for law.
Makes me wonder how often he violates the law to get what he wants.

It has been suggested to me by a cop I know that perhaps they were trying to protect the guy they were trying to get the blood from. He was a victim in the crash, a commercial truck driver and a reserve police officer.

It is possible, just possible, that they believed they needed the blood sample to protect him or help him in any ensuing litigation, challenge to his commercial driver’s license or to his badge.

None of that is meant to excuse any of this behavior. It is just a possible, albeit it very thin, explanation of their motivations.

That cop is a scumbag. Imagine the crap he’s gotten away with. Will be interesting to read the comments about the two white shirts who barely lifted a limp wrist to defend the lady.

Agreed. She held her ground against a thug with a badge and a gun. And she tried to do what she knew was right. She will - I hope - win a huge lawsuit against the city. G-d bless her.

Pretty tough for for someone to violate implied consent when they are unconscious. If he doesn’t consent he suffers a penalty. Well, he wasn’t able to make a decision. Wouldn’t it also be required to suspect the driver of a crime?

Perhaps if she kept her cool and didn’t resort to screaming and being dragged - perhaps she and the victim would have been better served.

That is a false statement. The nurse was calm and respectful right up until the point of arrest.

Shame on you defending this thuggery.
