Chief Justice Appears To Take Shot Across Gorsuch’s Bow

In remarks given at a judicial conference in Pennsylvania this week, Roberts reiterated his long-held view that the Court should speak with one voice wherever possible — that is to say, he supports a consensus-driven approach to opinion writing in which the justices strive for unanimity and avoid writing their own concurrences or dissents. In doing so, he appeared to rebuke Gorsuch, who has flashed a propensity for writing on his own in his first months as a justice.

Warren Burger ? He deserves credit for restoring the Chief Justice office so diminished and politicized by Warren.

Has a younger justice resigned the court ? Yes. John Rutledge, John Blair (OK, he was a year older than Roberts), Thomas Johnson, Oliver Ellsworth, Alfred Moore, Benjamin Robbins Curtis, John Archibald Campbell, David Davis, William Henry Moody, Hughes, James F. Byrnes, Charles Evans Whittaker, Arthur Goldberg & Abe Fortas.

Better than Warren of course but there were a few bad rulings right? Roe, though he flip flopped later, I didn’t know that, pity it wasn’t the difference. School busing. He sounds a lot better than I thought, I must have had a bad impression of him cause of Roe.

As for the resignations, lets see, Fortas was a scandal, Golberg, appointed UN Ambassador.

Looks like Whittaker (Ike appointee) was the last to just cash out, and while Kennedy was President too, great move. He wasn’t on the court long at all.

Burger had to deal with a generally radical leftist court, which isn’t his fault. Douglas, Marshall, Herod Blackman, Brennan. Ugly.

Roberts was a regular justice until George W. Bush nominated him for Chief Justice.

I’m not sure if Roberts can resign the Chief Justice position, yet stay on the court when the court is full. That would require the president to choose the new Chief Justice from the judges currently sitting on the court. The president might not want to appoint, and Congress might not want to confirm, one of the sitting associate judges. In that case it would seem Roberts would have to leave the court.

Good question. Roberts is a total disgrace. This entire country is so unlike anything our founding fathers created/wrote the constitution for plus did so much more for that all of us should be shamed into taking serious action. I cannot picture Washington, Jefferson, nor a single one of them walking among all the ungrateful SOB’s who refuse to work, assimilate, learn English etc. It is disgusting that our nation is a damn joke with the likes of Ginsberg and pals.

You are correct about Reagan nominating Justice Anthony Kennedy but only after the Democrats savaged his first nomination, the conservative Robert Bork. The Democrats and 6 RINOs blocked Bork. The Democrats and RINOs stuck together blocking a conservative to prevent the court from going solidly to the right. Reagan then had to nominate a moderate to fill the vacancy. Spinless Republicans roll over and approve the nominations of radical leftists like Ginsburg, Kagan, Sotomayor, ad nauseam. Democrats fight. Republicans just enjoy the perks of the office.
