The Buck Stops Everywhere Else: Trump undermines his own travel ban
Wall Street Journal ^ | June 5, 2017

...

Mr. Trump’s more consequential eruption was against Mr. Trump’s Justice Department. He was evidently responding to a segment on MSNBC’s “ Morning Joe ” about his executive order temporarily suspending immigration entry from six countries with a history of terrorism.

“People, the lawyers and the courts can call it whatever they want,” Mr. Trump wrote. “I am calling it what we need and what it is, a TRAVEL BAN!” Mr. Trump added that “The Justice Dept. should have stayed with the original Travel Ban, not the watered down, politically correct version they submitted to S.C.”

These comments are reckless on multiple levels. The original blunderbuss order was rolled out on the Friday night of Mr. Trump’s first week as President with zero public explanation and little internal vetting. White House staffers from the Steve Bannon wing preferred the stun-grenade approach, but Mr. Trump’s legal team convinced him to sign a legally bulletproof revision in March because they preferred to win in court.

The new order wasn’t “watered down” on substance but did make pragmatic exceptions for, say, permanent residents with green cards and military translators. Had the White House done such legal due diligence in the first place, the travel ban might not have become a political bonfire—not least because the President enjoys wide constitutional and statutory discretion over immigration and national security.

If Mr. Trump’s action is legal on the merits, he seems to be angry that his lawyers are trying to vindicate the rule of law. Attorney General Jeff Sessions would be justified if he resigned, and this is merely the latest incident in which Mr. Trump popping off undermined his own lawyers.

A legal team formulates a strategy to win a case. The strategy clearly Involves not calling it a travel ban. Top aides..spicer..conway..kelly..etc have said it is not a travel ban

The client is screwing up the legal teams strategy.

Btw.trump directs doj..he can direct them to go with the first travel ban.

Trump is doing exactly what legal teAms fear from their clients they represent.

It is jeopardizing the case..

"Sessions is a little slow on the take up. DOJ is in need of a leader."

Absolutely. What a total disappointment Sessions has turned out to be.

-- Will my country recover? --

"You can never go back" is how the saw goes.

I don't know. I'm not hopeful, getting back self-governance depends on a public awakening.

What’s lost can never be recovered - or else it looks like something very strange.

A legal team formulates a strategy to win a case. The strategy clearly Involves not calling it a travel ban.

The "strategy" not to call it a travel ban is meaningless, politically correct nonsense, that stiffles the truth. It gives ammunition to Big Media against anybody (such as Trump) who would speak the truth.

Trump is doing exactly what legal teAms fear from their clients they represent. It is jeopardizing the case..

The case should be an open-and-shut win. If the case is lost, it's because of a SCOTUS that is predisposed to rule incorrectly.

This is not an open and shut case. Trump is hindering the legal team

This article might help show you some problems...and why many lawyers..including conway have a problem with the client trump tweeting...but I suspect you wont get it.

I notice all the hand wringers have the same attribute - they abide by irrational tyrants, just because the tyrants are wearing black robes.

New rule of law, tweets control the constitutionality of statutory language.

Lawyers are the most chicken-shit risk averse people on the planet, and second only to the press (and the judiciary) in their dishonesty.

You ignored what I posted to you and instead of explaining your point of view in your own words, you tell me to go read somebody else's words.

I suspect you aren't able...

I didnt ignore it. This is not an open and shut case. I gave you an article that goes Into great depths about the legal ramifications....and shows why lawyers were very likely doing face palms after seeing their client’s tweets.

Trump should have shut up about it...but clients frequently dont do what is In their best legal Interests.

Btw.the oral arguments in the case will be made available online. Its better to listen than to just read the transcripts.

Mark my words...you will hear a lot about these recent tweets in the arguments

‘The judges below found that campaign rhetoric and other off the cuff remarks control the outcome of analysis of the language of an EO.

I’m with Trump on this - if SCOTUS wants to join in that means of legal analysis, by all means, get it in the open.

The hand-wringers (like Kellyanne Conway’s husband) are lawyers who defer to “legal analysis of EO by reference to twitter.” More idiots. As if there is a shortage.’

Nailed it!

’The Supreme Court will determine if President Trump has the right to enforce his Constitutional/Congressional mandated immigration powers.’

You’re right...but how pathetic that it’s come to this. The law is crystal clear. Trump has the absolute right. Yet there are feather-brains saying he only has the right if he talks and tweets a certain way.

We live in the age of idiocy. We really do.

‘The travel ban became a political bonfire because of activist Democrat judges and the Anti-American Big Media. And now we add to that a bunch of hand wringing politically correct RINOs who are afraid of their own shadow whining about Trump.’

So true!
