The 9th Circus was probably made when 5000 (American) people lived in all the Western states. It’s outdated now.
Shrink it down to just CA and HI (and maybe WA). We need to get Oregon back. Get away from Portland and things get red really fast.
Would the gov be stuck with two rogue circuit courts? Judges are out of control at all levels in the US. Why would they trust that "conservatives" from LaLa Land wouldn't adhere to these attitudes after appointment?
I've been thinking about the situation. West Coast liberals do not accept that Trump won the election....he didn't out there. These out-of-control judges seem to be doing everything they can to stop the Trump administration from governing.
How the heck does Trump fix that problem? What those judges are doing is a Constitutional Crisis, a refusal to be governed. It's an act of secession. I don't think I'm exaggerating.

The court can be eliminated all together by congress. Then in a couple of years a new one authorized. That one would require judges appointed
I agree! That’s truly a stupid remark that’s rocket fuel for his “Trumps a dictator” detractors. Seriously, a president can do that exactly how? Equally as stupid is the decision not to appeal. If we don’t appeal, the ruling stands and never gets to the SCOTUS. Wtf?
Anytime an organization is pulled apart, or reorganized; the corporate culture changes in significant ways. Often, a culture change is the end goal. Based on that, I would be confident of changes — how those changes would manifest themselves in judgments, I couldn’t begin to guess. However, it’s apparent, from countless FR posts, that it’s unlikely things could get worse.
Specific States would not have to face far left San Francisco partisans when the inevitable lawfare suits hit them.
For example, the State of Arizona would not have faced them in the appeal of SB1070. A new federal circuit means a new beginning with judges who more represent the legal sentiment of the States they are from.

With just a bit of attention to the character of the judges appointed these things stand a FAR greater chance of NOT happening.

Wrong. By splitting the 9th Circuit in two, you end up with not enough judges to split between the new districts. New Judges would need to be appointed, to make sure each district had the proper quota of Judges. Guess who will appoint those new Judges to the Appeals bench. That’s right, Trump. And the new appointees would be conservative, not libs. Will help to better even out the split in numbers between libs vs. conservatives.
I do not believe he has that power as president. Congress has the authority to establish courts at the federal level other than the Supreme court. He would appoint the justices for the cpurys depending on the split of existing court and the senate would either approve or disappove them.

Perhaps, but the judges in the ninth have not shown any respect for other jurisdictions and seem to have no problem in issuing injunctions covering the entire USA.
It still is. I just checked and the only County is southern Oregon that leans left is the county that Medford sits in; Jackson County. The rest of Oregon is pretty conservative except of course the city of Portland and that's the problem with most cities these days. They attract the lib scum.
Been a long time since I’ve been out that way - truly loved the view across the Siskiyou mountains on my way up from Santa Ana. Only place out west I would ever consider living these days.
