Trump has Already Effectively Repealed Obamacare (Dick Morris)

Dick Morris says what I have said for a couple of weeks. Obamacare really has been killed, and no one noticed.

Trump told the IRS not to enforce the "individual mandate." That is the essential coercive element. No mandate, no O-care. Morris said he did this last week---in fact, I heard more than four weeks ago that the IRS was NOT enforcing this and just assumed it came from Trump.

Second, the requirement that you buy from an "approved" insurance company---Trump waived that as well by telling HHS to approve any policy as "qualifying."

Yes, some of the subsidies and other crap remains, but the individual mandate---which the USSC upheld---is gone and so is the other coercive mechanism.

And nobody noticed.

Without the mandate, the carriers will go bankrupt trying to make this work.

This is going to end with either a public option or a MASSIVE expansion of Medicaid.

When Trump does it - HE’S GREAT!

It will completely erase it so it will be as if it never happened!

If there is no penalty, there is no mandate!

A law that isn't enforced ceases to be a law in the real sense.

Trump will sign a bill either adding a public option to the ACA or expanding the Medicaid portion of the bill before the 2018 mid-terms.

He wants a win here and doesn’t care what it looks like. He’ll “compromise” with Pelosi, give terrified Republicans in the House cover, and have a beautiful signing ceremony talking about bipartisanship.

I think Turbo Tax did ask if you had that IRS form from your employer affirming you had coverage or if you had other coverage as required by law. I clicked yes, of course. Because I do. And that was the end of that.

I wonder if I clicked no. What would they have done. Probably nothing.

1. We know Trump is not opposed to single payer (his comments on Canada and Scotland)

2. We he says he is willing to work with Democrats on health care.

3. We know that Democrats aren’t going to repeal.

4. We know that no one is going to give up the coverage for those with a pre-existing condition.

What other options are there?

I don’t think Trump will go all the way to single-payer. He won’t find any Republican support there and he needs some.

But I think he could pull close to 100 Republicans to follow him on either a public option or vastly expanded Medicaid.

I suspected this. Instead of a heart shot it's a lung shot. It will still bleed out and die you just have to track it farther.

Some version of it will be alive.

Trump has promised to cover everyone.

Republicans have promised that people with pre-existing conditions will be covered.

If Obamacare collapses after these types of promises - with nothing in place to replace it - Republicans will be wiped out in whatever election follows.

Hasn’t happened in American history. No law, once un-enforced, has ever later been enforced. (Illegal immigration might be a first, but quite different).

one would think that, but why would the Insurance companies think being limited is ok ? The only way to continue to make the profits is to continually raise premiums ? probably.

The Affordable Care Act requires health insurers tin the individual and small group markets to spend at least 80 percent of the premiums they received on healthcare services and activities to improve health care quality(in the large group market, the amount is 85 percent).

This is referred to as the Medical Loss Ratio (MLR) rule or the 80/20 rule. If a health insurer does not spend at least 80 percent of the premiums it receives on health care services and activities to improve healthcare quality, the insurer must rebate the difference.

Are insurers still mandated to cover existing conditions... without charging the already-sick person higher premiums commensurate with the “risk”? (No longer a risk, it’s a money pit. Try calling to buy homeowners’ insurance while your house is burning. That’s NOT insurance; at that point, you should be shopping for a mortgage on a replacement house!)

If people are still able to get “insurance” for existing conditions, and pay the same premiums as healthy people, Obamacare has NOT been repealed, effectively or otherwise.
