Lindsey Graham questions Gorsuch about impeaching Trump

South Carolina Sen. Lindsey Graham on Tuesday questioned Supreme Court nominee Neil Gorsuch about what it would take to impeach President Trump.

The Republican senator used a portion of his time for questions at the Senate Judiciary Committee's hearing to probe Gorsuch about the impeachment process.

"In case President Trump is watching, which he may very well be, one you did a good job picking Judge Gorsuch," Graham said to laughs, "and number two—here's the bad part—if you start waterboarding people, you may get impeached. Is that a fair summary?"

"Senator, the impeachment power belongs to this body," Gorsuch answered.

"That's even better," Graham replied. "Would he be subject to prosecution?"

"Senator, I'm not going to speculate," Gorsuch said.

"But he's not above the law," Graham replied.

"No man is above the law," Gorsuch said. "No man."

No, impeachment power belongs to the House of Representatives. The Senate is the trial court.

This guy is really off his rocker.

The impeachment process, of course is spelled out in the Constitution. Nothing in the process would suggest any basis for this insulting line of questioning. South Carolina's embarrassment is grandstanding, of course; but why in this way, in this setting?

Name recognition, familiarity? Maybe they have developed bonds with the voters in their states.

I’m not a politician, but I think it takes a lot to get a long-time incumbent out of office.

FYI the Chief Justice of the USSC presides over the Senate conviction debate in an impeachment-of-the-prez proceeding. That is the role of the court in impeachment.

The Chief Justice “presides” over the House process.

Other than that, the USSC has no role in Impeachment.

This is a stupid question by Graham.

The House writes up the charge, passes it onto the Senate.

The Senate must get a 2/3’s majority. With this scenario in place, it’s impossible to think of any way that an impeachment would happen with anyone.

Then they hand the paperwork over to the Sec of State. End of the whole process. No action by the Supreme Court.

The stupidity of Graham just amazes me that he wastes time like this and ask a question like this.

That's very evident to the point that if someone were to question him in the Senate, the chamber would erupt in laughter if he were to deny it. So, there's got to be something more damaging than that, more specific.
