Hawaii Judge's Flawed Aloha Akhbar Logic

The latest indication of the need to drain the judicial swamp comes in the form of Hawaii Judge Derrick Watson’s ruling placing a hold on President Trump’s second executive order placing a temporary immigration ban on six predominantly Muslim countries. It is, as President Trump noted, a classic case of "judicial overreach."

Judge Watson’s logic belongs in a parallel judicial universe where judges are allowed to regulate foreign policy, clearly a presidential prerogative defined in both law and the U.S. Constitution. Judge Watson cites no law and, in the case of the Constitution, says the travel ban violates the Establishment Clause which forbids favoring or disparaging a particular religion. By that logic, you could never restrict any immigration from any Muslim country for any reason. Judge Watson strays outside the four corners of the executive order and ignores explicit U.S. law to cite President Trump’s campaign statements, which are totally irrelevant. Motive, even if correctly discerned, is irrelevant here. Only the law and presidential authority should apply. As the Washington Post describes Judge Watson’s flawed logic:

I don't know, maybe it's just me but the header kinda hit a funny bone. "Aloha akhbar". Anyway, obviously purely political on the part of any of the "selected" judges this is put before. The statute that President Trump is using is clear cut. Past statements are not grounds for blocking the EO. Actually NOTHING should be blocking the EO.

Here’s the applicable logic: “U.S. District Judge Derrick Kahala Watson, who halted President Donald Trump’s revised travel ban Wednesday, is a 1984 graduate of Kamehameha Schools who was in President Barack Obama’s class at Harvard Law School.”

Can Judicial Watch request any meetings, telephone conversations etc between Obama and this judge? It stinks to high heaven that Obama makes an unannounced visit to Hawaii just before the ruling. Sort of like him making a quick trip out there just before his grandma died.

Fill their island paradise up with 10th century barbarians! They’ll love the climate, the mountains they can hide out in and the tourists and islanders they can attack for wearing bathing suits and roasting whole pigs at luaus! Yeah- a Hawaii filled with black bagged women will be a huge tourist attraction! No music, no pork, no hula, no bikini’s on beaches, it will be peaceful mix of cultural tolerance...lololol!

They just “chanced” by on their way to Tahiti. For a month. At about $13,000/day. Chapter out of the “Life Ain’t Fair” book. Old school buddies. I guess, since we don’t really have anything other than hearsay that he went to college. Wonder how come none of the profs remember him. Surely with that enormous personality someone should remember him. He’s just so charming. NOT!

Not being familiar with the process to ‘create’ a federal judge, what process needs to be followed to remove those same judges, if it is even possible? Are said judges not appointed?

Usually what happens is a bunch of politicians promote someone and that person is presented to the president who usually appoints someone his cronies in Congress have suggested and then those same cronies get him/her through the approval process. Usual vetting includes did well in law school, has lawyer friends, some experience and of course, believes in killing babies. boom.

As post 2 points out, this fake judge has the same credentials as our fake president, Obama. No wonder that the decision is an abomination and without law or sense. Plus, the judge granted a nationwide temporary restraining order. TROs are not to be done unless the matter is very likely to be sustained on review and should be limited in scope but, this judge made it way broad and with little reasoning to have it upheld.

An interesting side note. All those Hawaiian officials glorifying the judges ruling never mentioned that Hawaii has taken in a single refugee. Why you ask? It seems that it’s just too expensive to live there for them.

Since Illegals seem to do just fine in some of the most expensive zip codes on the west coast, the concern over refugees in HI must come from other self serving reasoning.

Obama came and took him out to dinner to get this ruling. They graduated together at HAAHvurd. The restaurant has them pictured together on their Facebook page.

Impeach the judge.

…Something tells me that the new Trump order was worded and issued in such a way that it will prevail in court. Hope our side is that smart.

President appoints judges who are confirmed by a majority of the Senate. The appointment is for life. Only way to remove them is impeachment by the House and conviction by the Senate. It takes 2/3 majority of Senate to convict.

The question that begs to be answered is, Is President Trump going to let the decision stand? Or to put it another way, what is he going to do about it? President Trump should tell him to to go fly a kite. But not in those words. “Those words” cannot be said or typed on this forum.

The United States Senate has removed judges from office for substantial questionable conduct, even if no crime was committed. For example, Judge Robert Wodrow Archbald was impeached and removed from office for improper business relationships with litigants. One reason for this may be the life tenure bestowed upon federal judges and the Congress’ place in upholding the “good behavior” of judges.

You wonder why the liberals accepted Obama’s evolution from an anti gay marriage supporter to his “newly” evolved support for gay marriage but can’t even imagine that Trump “evolved” from his campaign rhetoric to his policy statement even though that shouldn’t have a rat’s ass impact on the judge’s ruling
