With California's 'sanctuary cities,' Trump might be starting a fight he can't win

President Trump wasted no time inviting a showdown with California and other liberal states with his threat this week against so-called sanctuary cities, setting off a frenzy of resistance that will test the president’s power to carry out his vision to deport millions of people here illegally.

The executive order Trump issued Wednesday putting cities and counties on notice that they would lose federal funding if they didn’t start cooperating with immigration agents has broad implications for California, a state that aggressively protects its undocumented population from deportation.

But while the order allowed Trump to boast that he is fulfilling a campaign pledge, it also commits him to a fight that he is not necessarily poised to win.

The cities and counties Trump is targeting have many tools to strike back. Among the most potent are high court decisions that have interpreted financial threats like the one Trump is now making as an unlawful intrusion on state’s rights.

True. But they cannot stop BP/HSA/ICE from operating at their pleasure in the state. Or not. Trump could just stand by and let the sanctuary city be flooded with Illegals. Critical mass won’t take long.

I believe California issues drivers licenses to illegals. Homeland Security could invalidate the use of EVERY California drivers license for any federal purpose of identification. That would include entry to federal buildings, TSA screenings, banking and federally sponsored assistance programs. If all Californians are inconvenienced by the leftist legislators, mayhaps the legislators will wisen up.

I say if these sanctuary
areas are really itching
for a sh*t storm, president
Trump should oblige.
Reduce their federal
funding including
FEMA funds. Stop all
Remittances to illegals
for SNAP, welfare, and tax
credits. Let the States, counties,
and cities support them with state
and local taxes.

You make an excellent point. Our country is very unique in that we do not have a national police force. Mexico has the federales for example. We have the border control and ICE...fairly small national law enforcement agencies.

State and local police are not hired to enforce immigration law...although in days gone by there was usually willing cooperation between states and feds. The bottom line is local governments have no legal obligation to turn illegal immigrants over to the feds.

But....to interact with any government agency, people need to have a legal status which can only be obtained through the federal government. This means having a social security number or a passport or a work visa etc. States and local governments often ignore the fact that when letting people into schools, colleges, welfare programs etc. California issues drivers license to people who aren’t citizens as well.

This is where the leverage lies for those of us people who simply want our laws followed. Any agency, public or private, that employs are assist an illegal immigrant (in the case of benefits) without a legal status can be subject to harsh penalties from the federal government because they are in fact helping a criminal break our immigration laws.

I'd be curious to know how many illegal aliens have taken advantage of this in California, because it actually works against illegal aliens in some ways. For one thing, the license you get as an illegal alien is not the same as the one you get as a U.S. citizen or legal immigrant. So anyone who sees the license is going to know right away that the person is in the country illegally.

I'm also not sure the licensing of an illegal alien is all that relevant here. I suspect most states don't have any mechanism to enforce this sort of thing anyway. For example, if I am here in the U.S. on a one-year visa and then the visa expires but I stay here, what mechanism does a state like California have to cancel my driver's license?

Well said. My point is that it is that local governments are breaking no laws when they refuse to help the feds with illegal immigration. But they (and private employers as well), are in fact breaking laws when they aid and abet illegal immigrants. The technicalities of how the feds can use this leverage is for smart people such as yourself to figure out.

Right -- but I should clarify something here. My previous comment about states like California that issue different driver's licenses to illegal aliens is only partly true. They give them a different license, but the license could be obtained by anyone who wishes to obtain a license that does not meet Federal standards for identification (for TSA purposes, in particular). So anyone who sees the license may assume that the person is an illegal alien but will not be certain of it. More importantly, anyone other than a Federal employee or someone interested in turning them over to ICE may have no reason to even ask them about their legal status in the U.S.

Yes. Good point about the license. Naturally, anyone with such a license is not necessarily in the country illegally and should not be treated as such....at least from a legal standpoint.

UC Berkeley has several dozens....if not hundreds...of students in attendance who are in this country illegally (which may be one of the reasons my nephew didn’t get in by the way). The University is therefore necessarily using federal money to help illegal immigrants. As we agree, they are under no obligation to turn the illegal immigrants over the the feds, but the Feds can likely cut federal funds to the university for supporting non-citizens over citizens.

State’s rights? How come these libs see contradicting established federal law as a state’s rights issue? What would they say if, say, Wyoming and Kansas decided to not participate in the provisions of the NFA and the Gun Control Act of 1968? I assume they would say that threats by the feds have no importance! You can’t have it both ways.

Fine. Show up at city counsel meetings and arrest every one of them. Charge the thusly:

Federal Immigration and Nationality Act Section 8 USC 1324(a)(1)(A)(iv)(b)(iii) “Any person who . . . encourages or induces an alien to . . . reside . . . knowing or in reckless disregard of the fact that such . . . residence is . . . in violation of law, shall be punished as provided . . . for each alien in respect to whom such a violation occurs . . . fined under title 18 . . . imprisoned not more than 5 years, or both.”

Section 274 felonies under the federal Immigration and Nationality Act, INA 274A(a)(1)(A):

A person (including a group of persons, business, organization, or local government) commits a federal felony when she or he:

* assists an alien s/he should reasonably know is illegally in the U.S. or who lacks employment authorization, by transporting, sheltering, or assisting him or her to obtain employment, or

etc, etc
