Yes, but that’s not the tack I would take as it puts President Trump in the defensive position and is likely to result in impeachment.

If Trump ignored a court order, the left would make it number one on their articles of impeachment.

He could ignore it, but the political blowback would be huge. Probably better to beat it in court.

Exactly right. Trump's presidential directive can be rescinded neutering the court's intervention. He can actually exercise more control in this case by appearing to back down.

Trump has executive control of State and the DOJ now and can enforce any existing law.

It just takes spirited leadership. State needs to be redirected from within. They have always been jelly spined sycophants. The SecState can and needs to direct how visas are issued up to and including his specific and explicit approval of each and every one if necessary.

ICE is already starting to show they are feeling their oats. They are a figurative tiger that has been chained up until now. The new DOJ looks like it will support them 100%.

Yes.

If there is anything liberal politicians and judges and activists have taught me over the past 8 years it’s that you’re under no obligation to follow laws you don’t like.

Whether it is immigration laws, the 1st Amendment free speech/free religion.

Laws are just suggestions.

Oh wait, I think you have to a minority to break the law and get away with it.

Probably the only kind of precedent worth establishing: the courts cannot and do not have a say in immigration policy.

I’m all for him telling that unconstitutionally political activist judge to go to hell, but I trust Trump on this one. He’s going to have it established that the courts have no say in immigration, especially at a level that is not the supreme court.

The judiciary seems to be willing to create a constitutional crisis, and risk civil war, just to play politics with the lives of the American People.

The President shouldn't ignore the order, because he still has the option of appealing it to the USSC.

I can't imagine the USSC weakening the office of the Presidency in such a blatant and unconstitutional way. This is a cut and dried, obvious case of the 9th circuit ignoring the law and constitution. If the federal judiciary is really going to be this out of control, we might as well find out if the USSC is of the same mind.

Unless Gorsuch can be confirmed quickly using the nuclear option, I think this decision should be appealed immediately, and if the SCOTUS wants to push this country towards civil war by ignoring the US Code and Constitution, then that's on them, not the President.

This isn't a game. The integrity of the Republic is now at stake...

Skimmed thru the ruling, send admin hurt their own case by the inconsistent application of the EO. Another take is that perhaps more detail is needed. They also quote campaign rhetoric to say it’s actually a de facto ban on Muslims although EO doesn’t say this.

I wonder if the EO went thru proper internal review and critique which might have sharpened up the language?

I hope we’ll see an explanation from a credible legal eagle in the next day or two.

Those judges ignore the clearly written code as stated by Donald Trump which the news people seem to ignore... like those judges.

That might have applied to a pansy clown like Bush, but Trump isn't going to allow a hack judge to set national policy.

Don't forget: Trump likes to WIN. He's been dealing with hacks like this for 40 years. Immigration was his SIGNATURE issue. He will win this.

Trump followed established, clear cut law in his EO. I hope you’re not saying he needs lawyers who are good at making law to fight other lawyers good at making law. Isn’t that the problem? Lawyers who think their job is to make laws? Maybe I misunderstood you.

I think a better plan is to get Gorsuch in place first and then prevail in the SC.

Very sound advice. Pick the fights you know you will win.

Right now President Trump can rely on his Sec State and Attorney General to whip their departments into compliance to existing laws. Both departments have been operating outside those limits for the past 8 years.

Tactically, rescinding his current directive would neuter the court's intervention without getting bogged down in a constitutional fight. It would also reduce antagonistic rhetoric (OK nothing can stop the verbal diarreah from piglosi and little chuckie schumer) and focus on enabling him to get the new justice(s) into the SCOTUS.

Once all these are done he can HAMMER the bastards. Until then he needs to keep his ego in check and eat the apple one bite at a time.
