Dems Won't Rule Out Endangered Species Act Suits To Block Trump's Wall
Daily Caller ^ | January 27, 2017 | Michael Bastasch

President Trump's political opponents may use existing federal laws designed to protect endangered species to stop him from building a border wall to stem the flow of illegal immigrants coming from Mexico.

Environmentalists say Trump's proposed border wall would hinder the movement of endangered species migrating through their natural, cross-border habitats, and activists aren’t above filing suit under the Endangered Species Act (ESA) to stop the wall.

"Litigation is just one tool in our advocacy work, and we take nothing off the table," she said.

Jaguars and ocelots, for examples, are endangered species whose range extends along the U.S.-Mexico border. They are more abundant in Mexico than the U.S., so they could pose hurdles if portions of the wall cross through their habitats.

"We will not stand by while Trump creates a Berlin Wall on America’s border," Kierán Suckling, CBD’s executive director, said in a statement. "We'll fight this Stone Age proposal in every way we can - and if necessary put our bodies in front of the bulldozers."

Tell them to ask about all the bodily waste and litter that gets dumped on the border, is that good for endangered species?

Seems I recall something along the lines of sovereign immunity being applied as far as the EPA and toxic spills into some river somewhere.

Are they really sure they want to go there?

I have assumed all along that the greenies would try lawsuits on this count. The argument about jaguars and ocelots has been out there for a long time. Fortunately the DHS enabling legislation should allow for the ESA to be over ridden.

Nah we need plasma canon armed Terminators and Aerial Hunter Killers to patrol the border.

The should ask Rachel Corrie how well that works.

Well, if Trump writes an Exec Order wiping out “Endangered Species Act”, that should undermine any bogus suit.

Keep in mind that the concept of “Endangered Species” has become a fraud.

For more than 30 years, professors have had students conduct “field work” to go into wild spaces across America and “identify” a “unique species” in a given area.

The fact is, they are NOT “unique species”, but they are used to develop a catalogue of objections to ANY development, anywhere in America.

But, try going into court to prove them wrong......long, expensive process.

Actually, jaguars (the actual cats, not cars or airplanes) have recently been seen and photographed in Texas and New Mexico. Personally I think the US government should be breeding jaguars and perhaps using them for additional border patrol forces in addition to preserving the species.

So, I’m a Roman emperor (pick one), and my generals say we are going to be invaded, and need to fortify our SW border.

I ask, what do you propose doing?

Sextus says, we were going to build a wall, but Brutus says we can’t because there is a snail darter in the Rubicon.

I, Roman emperor X decrees Brutus to be crucified tomorrow.

Upside down.

Problem solved.

The problem is that these laws give third-party activists the right to go to court and file suit. That needs to be stripped from all Federal law TODAY.

Another self-destructive act from the progressives. People want a wall. Americans know what the Mexican/US border looks like. The illegals destroy and trash everything they touch. Stopping the illegals will clean up the environment.
