I believe the said that if he were king and there was no Constitution, he would make it against the law to burn the flag.
And being that Justice Scalia understood that he was not king and we did have a Constitution with a First Amendment, he voted with the majority in Texas v. Johnson.

I emailed trump people earlier tonight about this, a country cannot have freedom of speech and also have hate speech crimes/penalties.
It’s like trying to cut a baby (speech) in two. It (the country and people as a whole) will not survive/thrive.

How the laws should be and how they are are two entirely different things.
The way it is, is that non-citizens, with very few exceptions, are protected by the Bill of Rights.
That’s free speech, that’s right to bear arms for legal non citizens, that’s 4th-6th Amendment Rights.

I would not make it illegal (even though I despise it). So far the only think I know of that I disagree with Scalia on. And yet another thing to admire him for: He did what is right and constitutional, not what he preferred.

and I should have further said - people so easily offended are the ones with unbalanced thinking. They need to address it not everyone walk on egg shells around them.
I can speak of this because I used to be easily offended.

US Code Notes (a) (1) Whoever knowingly mutilates, defaces, physically defiles, burns, maintains on the floor or ground, or tramples upon any flag of the United States shall be fined under this title or imprisoned for not more than one year, or both. (2) This subsection does not prohibit any conduct consisting of the disposal of a flag when it has become worn or soiled. (b) As used in this section, the term flag of the United States means any flag of the United States, or any part thereof, made of any substance, of any size, in a form that is commonly displayed.
