The electoral college system for choosing the President was based upon the protection of slavery and a distrust of democracy. That system has allowed the loser of the popular vote to win the Presidency in five of our 56 Presidential elections. Such a system would be illegal in any state or local election. But it is contained in the Constitution. Can a section of the Constitution itself be unconstitutional? The answer is yes. We are all aware by now that we do not vote directly for a candidate in a Presidential election. We vote for electors who will (presumably) vote for the candidate who won the popular vote in the state, when the college meets after the election. Under Article II, Sect. 2 of the Constitution (later modified by the Twelfth Amendment), the number of electors is determined by combining the number of members of the House of Representatives in each state and its two Senators.

Most everything the left wants is not in it. Abortion, right to privacy, equal outcomes, LBSQ-MOUSE-ism among thousands of examples.
It’s just a good idea. Without it the east and west coasts decide the vote.
They’ll find some quibble with a flawed system and use that as an excuse to try to mow the whole thing down wholesale.
The proportional rule for slaves was a compromise between those who wanted to reward states embracing slavery (by counting them as whole people even though they could not vote) and those who wanted to punish states embracing slavery (by counting them as nobody as long as they were not free).
Surely I must be only about the 50,000,000th person to observe that the interest of slaves would have been best served had they not counted for a state at all.

No, the Constitution is not, in fact, unconstitutional.
Thank God we avoided placing any more anti-Constitutionalists like this one into the judiciary. I honestly do not think the Constitution would have survived Hillary’s appointees to the Supreme Court. They would have dropped any pretense that their legislating from the bench is in any way Constitutional, and the country would have become a playground for ultra leftists to impose their will onto.
Thank God we elected Trump, and the Constitution is safe from idiots like this one.
