In what will hopefully be one of the final acts of the Obama Administration on firearms, the ATF on Monday announced that its proposed changes to the Form 4473 would go into effect on January 16, 2017, just four days before the inauguration of President-Elect Donald Trump.
Form 4473 is the federally mandated form that must be filled out by any person who acquires a firearm from a licensed dealer....
Another notable change to the form is the inclusion of a bolded warning to potential transferees from ATF.
The warning provides that the use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medical or recreational purposes in the state where you reside.
This warning is a continuation of ATFs policy that was first published in an open letter on September 21, 2011.
Under ATFs policy, not only are users of marijuana prohibited from possessing firearms, but a person may not transfer a firearm to an individual if the transferor knows that the transferee holds a medical marijuana card.
Importantly, this second prohibition applies even where the cardholder does not actually use any marijuana.

President Trump should simply put the ATF completely out of business forms and all. They exist simply to thwart the Second Amendment.

No, they are enfocring the law as it exists. AND I hate the BATF with every fiber in my body. As long as they exist and mj is still illegal federally they are correct.
It seems a serious over-reach to me that unelected bureaucratic rule-makers can interpret (dictate) that which is clearly enumerated in the Constitution.
If Trump is true to his word, a lot of this Federal nonsense with regard to the 2nd Amendment will be negated/legislated away.
A president does not have that sort of power, nor should he. Legislation is needed.
With any luck, he will appoint a head of ATF to drain the swamp.
As a licensed firearms dealer I will say that this new form includes some improvements. The form clarifies and simplifies some common confusions. There are a couple of minor things that don’t represent an improvement but, generally, the new form is better than the old form.
This is nothing to get up in arms about.
It’s a warning of an existing policy. I can’t get too worked up about that.
Either do away with the BATFE (”F-Troop”) altogether or take away their tacticool weapons and gear and send them back to hunting down tax evaders illegally running cigarettes and booze with no tax stamps.

This is one agency that needs to go away along with form 4473.

Actually I support these changes in the sense that it will very possibly WAKE UP the Republicans in Congress to improve the laws and thus the net effect will be positive. But, for now, we just have to live with it.

Well, if getting rid of it is on his agenda, it’s the first step. Appointing someone to oversee shrinking what it does is step 2. Getting a Republican majority to shut it down is step #3.

I know being correct around here is a lonely position.
We cannot ask our federal agents to enforce, say immigration laws, and not enforce gun laws as they are written.
