Federal Court Rules That Botched 43-Minute Execution of Oklahoma Man Was Humane

The botched execution of an Oklahoma man involving an experimental dose of lethal drugs was not inhumane, a federal judge ruled.

The ruling by a federal appeals court on Tuesday upheld the dismissal of a lawsuit filed by family of Clayton Lockett, whose April 29, 2014 execution took nearly an hour instead of the minutes it should have.

Lockett’s brother, Gary Lockett, sued Gov. Mark Fallin (R-Okla.) and other state and prison officials saying the drawn out death of his sibling was “barbaric” and that the fumbled execution violated the inmate’s constitutional protections against cruel and unusual punishment.

Lockett, imprisoned at an Oklahoma state penitentiary for fatally shooting and burying alive a 19-year-old woman in 1999, was administered a cocktail of midazolam, vecuronium bromide and potassium chloride, a mix of lethal drugs never before used in Oklahoma.

Strap the condemned down, put on a breathing mask and a brain wave monitor, supply 99% industrial nitrogen (welding gas) at 1.1 atmospheres, the condemned passes out, wait till the brain waves go flat, Ventilate the room, cart the body off.

They should give them a choice. Hanging, firing squad, or lethal dose of drug of their choice, i.e. heroine, cocaine or whatever concoction is provided now. Make the concoction the default choice.

Any form of execution that can take 30-45 minutes or even an hour or more is unacceptable. We need to abolish lethal injection and bring back hanging. Even in a “botched” hanging they are dead inside of ten minutes.

Exactly, there are many ways even if they don’t want to return to lead poisoning, which would be fine by me.

One reason Nebraska got rid of the death penalty was the difficulty in buying the drugs needed for lethal injection. You just solved that problem.

“Barbaric” describes what this animal did to his victim. The execution took long, but I doubt the perp was even aware of time. He was, most likely in la-la land.

My whole life I wondered how is this hard. Twilight sedatives. Then replace the air with CO2. CO2 will produce a mild euphoric effect so will deflect any cruelty claim. Five minutes or less.

Or sit them in a running car in a closed garage.

Execution should not be medicalized. Hospital gurney, intravenous access, tranquilizer, paralytic, electrolyte in excess.

That's perverted.

Use dedicated instruments of death to kill. Rifles. Bullets. A clean quick death.

I had surgery not too long after seeing Dead Man Walking. So confidence inspiring, arms strapped to the arm supports of the operating table, the needle inserted, drugs flowing...

I'm a nurse. If I had to kill a condemned prisoner, I'd a whole lot sooner pick up a rifle than an IV set. Sanctity comes from separation, keeping things apart. Medicine should be dedicated to life. There are weapons enough for death.

Little sympathy here.

As for “c&u” punishment - it was an accident. “Fumbling” is not the same as “deliberate”.

There have been fumbled neck-breakings in the past, I guarantee. Probably not too much whining about “cruel” when they subject obviously was so himself.

Yeah, I agree. We’re delivering justice not vengeance - even if these animals deserve it. Those who earn permanent justice should get it swiftly - bullet, rope, etc.

Sooo...not botched, then. Perhaps even a bit more satisfying for the family and friends of the victim. Definitely not botched.
