This is why DoD for years made a clear distinction between bribery and graft on one hand and gratuities on the other. Bribery and graft imply a quid pro quo. But a gratuity simply means a “gift” to a federal official.
This is a typical Clinton quibble, as others point out. Even if no direct bribery or graft can be proven, any other government employee would be in prison for accepting gratuities.

I'm not familiar with laws regarding conflicts of interest.
I am a little familiar with laws regarding the handling of classified information. The laws were written so that the government would be relieved of the burden of showing that trusted officials transferred information to the enemies of America. It is sufficient that they handled the information in such a way that a transfer could happen in an undetected manner.
If, for example, an official stores classified documents in an approved safe, then evidence that the safe was compromised would indicate that the secrets may have been compromised. That is why using an approved safe is required.
If, instead, the official leaves documents unattended on their desk, then spies might be able to photocopy them without detection. Such behavior is ILLEGAL; it is gross negligence and should be punished by imprisonment. Unfortunately, that didn't happen to Hillary because Comey lied about the law and most listeners didn't understand why the law exists the way it does.
The various donations to the Clinton Foundation by people seeking access to the Secretary of State illustrates why we should have similar laws regarding "grossly unmanaged conflicts of interest". Failing to have an objective third party managing Hillary's conflicts of interest should be made a crime, even if it is not a crime today.
In virtually every well run business, failing to properly manage a conflict of interest is grounds for immediate termination of employment with prejudice.

Since we have recent evidence that Yemen, as just one example, made large “donations” to the Clinton slush/money laundering Foundation in exchange for the attention of Her Excellency, once again Hillary is caught on a stool with cookie crumbs on her chin, and a broken cookie jar on the floor, adamantly denying that she got into the cookies.
Well, that's a relief! Because if you look at the evidence, it would seem to point to blatant and rampant corruption.
Isn't it gracious of Hillary Clinton to help clear up this issue for a skeptical Media?
