No, Loretta Lynch Is Not ‘Recusing Herself’ from Emailgate

Big News, via the New York Times: “Lynch to Accept Guidance of F.B.I. in Clinton Email Inquiry”....

Just one problem: It’s not true. Here’s Bloomberg’s Mark Halperin, citing a senior DOJ official: Attorney General Lynch reserves the right to overrule the recommendation of career prosecutors and the FBI in the Hillary Clinton email probe. This official says the probability she would overrule is “very, very low,” but it is not zero.

In other words, Lynch is not “recusing herself,” as has been rumored, and she is not committing herself to the FBI’s recommendation. Despite the “furor,” nothing has changed.

And, for the record, you can be sure that “very, very low” will be just high enough when the time comes.

The media and the dems think this is all about nothing and a trumped up right wing smear campaign. Look how the media and the dems handled the Benghazi report. No one remembers anything Gowdy said, they just remember the endless sound bites of Hillary saying nothing new time to move on and the NYT claiming it was a waste of taxpayer money. I heard more about Stevens families comments than I did about the report.

-ie legal wiggle room! and no timeline!

she should resign. a great move would be for Comey to unload the bomb before the end of the news cycle today (if he has any bomb to drop).

At least she said that the indicment decision comes from a team, and the team includes prosecutors (not FBI people, but DOJ people).

Investigators gather facts and conclude either probable cause, or not probable cause. If there is not probable cause, they don't forward the file.

"Presence of probable cause" isn't a recommendation one way or the other, although I am sure the investigators are biased in favor of prosecution whenever they find probable cause a crime has been committed.

I am just glad my parents aren’t here to experience this nightmare.
Terrified that we will see an explosion of Isis in this country on the 4th. .. I feel like they’re going to unleash it all and I am just heartsick over the whole thing. Sold down the river by the last 4 administrations. Never thought I’d feel that way about the Bushes but. ....

No doubt Bush is/was part of the problem, but the media did not give him a pass. It was a constant drum beat from the media. The Scooter Libby thing was pounded everyday and it does not come close to the issue of Hillary using a private server, erasing all her emails and not turning them over until two years after leaving the State Dept. if this was a SOS Rice she would have been indicted by now. I find it odd that I don't really hear any Republican leaders commenting on this issue. The only commenting I read or hear about is mostly from media and dems calming this is nothing but a right wing smear. The fix is in!

Indicting isn’t convicting. There is every legal and evidentiary reason to indict and everyone knows this.

You are technically still presumed innocent while under indictment.... So any one of us would be indicted with this much public evidence.

However, it kills her chances of being the nominee. AND THIS IS THE ONLY FACT THESE CORRUPT OFFICIALS ARE MAKING THEIR DECISION ON.

The fact that she is running for President should not be the top fact they use to make a decision whether to indict. Another fact that shouldn’t play a part is any threat Lynch may have received.

THE EVIDENCE DEMANDS INDICTMENT. More investigation. That’s the truth.

I agree with everything you wrote.

My points are that the indict or not qestiion rests entirely in the DOJ, and that the FBI is not in the business of telling the DOJ whether or not to indict, although the implied (and actual) bias of the FBI, when it forwards a file to the DOJ, is that the facts support indictment.
