Federal Judge: U.S. Constitution Is Outdated, Judges Should Stop Studying It

According to 7th Circuit Judge Richard Posner in a post published to Slate, U.S. judges should stop studying the Constitution.

“I see absolutely no value to a judge of spending decades, years, months, weeks, day, hours, minutes, or seconds studying the Constitution, the history of its enactment, its amendments, and its implementation,” Posner argued.

“Eighteenth-century guys, however smart, could not foresee the culture, technology, etc., of the 21st century,” he continued. “Which means that the original Constitution, the Bill of Rights, and the post–Civil War amendments (including the 14th), do not speak to today.”

He’s right. Judges today need only know the preferences of the cultural and economic elite. They then declare that those are the law of the land. What else are they expected to do anymore?

I was just going to say the same thing. He has declared himself a god. He says that judges are just creating a common law, like in England. Except we, the people, never agreed to that.

Dennis Kucinich (former Mayor of Cleveland) filed them on W a dozen times. They did not go far, but at least he had the stones to do it.

Yup he sure did. There are no stones amongst the GOPee, nada, zip, zilch, ZERO. Everytime an opposition to Obie and the left is brought up their response is "Oh we don't want to lose the next election". What the he$$ are they there for???

When a judge can without consequence so openly and arrogantly impeach the founding document of our entire justice system.. it begins.

Our Christian founders and foundations are already dismissed and mocked. Noe the seculars come for the second cornerstone.

Is it a civic Jesus you want?

That won’t come, at least until the official Second Coming is scheduled.

However a personal Jesus can come any time you need, and will get you past the civic angst in full heavenly style.

He wrote this opinion on his own time and the piece had no direct connection with a case before him.

Yep.

The idea that we just need to appoint ‘conservative’ judges is the same kind of foolishness that holds that socialism will work if we just have the ‘right’ people in charge. In both cases, what’s wrong is the underlying theory and the monopoly education that precludes other views.
