Clinton tech aide plans to take the Fifth at deposition

A former information technology adviser to Hillary Clinton plans to exercise his Fifth Amendment right against self-incrimination at a deposition next week and wants to prevent any video recording being made of the session.

Lawyers for former State Department tech specialist Bryan Pagliano said in a court filing Wednesday that there's no valid reason to make an audio or video recording of the session since Pagliano doesn't plan to answer any of the questions he's asked by the conservative group Judicial Watch, which is pursuing a Freedom of Information Act lawsuit related to Clinton's private email server. The group is scheduled to take Pagliano's deposition on Monday.

He got immunity from prosecution yet will still plead the 5th. Why?

If I'm not mistaken, his prior immunity was with the FBI, this testimony is in front of a Senate committee and his lawyers have stated that they have not granted him immunity for his upcoming hearing......or something like that.

If a legitimate judge in a real court so orders, yes.

No legitimate judge will further this publicity stunt by Judicial Watch, however, so his risk is small.

Agree.

The Feds do not want him to testify in the civil case. Doing so would allow Hillary to see what he told the FBI, and give her the chance to prepare her lies.

Better that Hillary has no idea what ammo the Feds have awaiting her.

I think you are wrong. If all of the other depositions are videotaped, his should be also.

There are lots of questions he can be asked where the answer could not possibly be incriminating and a record of him answering those questions could have value.

And, if he slips up, even once, it could open the door to more.

In fact if Pagliano pleads the 5th for 3 or 4 hours straight in the depo, that can sped up to fit into the latest 30 campaign spot. A voice at the end will explain the audio had to be sped up to fit it all into the commercial. A little something for the humor factor.

Discovery is used to build a case if possible, and the case could be against someone else, not him.

He still has to answer every question truthfully except he is allowed to plead the fifth to those questions that would implicate himself in a crime committed.

I thought the Klintoons always had their underlings use the same attorneys as themselves so that they would ALWAYS know what every other “team” member had said, and nothing ever gets said without those common attorneys present.
