FORT BRAGG, N.C. (AP) -- Army Sgt. Bowe Bergdahl, who walked off his combat outpost in Afghanistan and spent five years in captivity, will be court-martialed under a new commander-in-chief.
A military judge decided Tuesday to delay Bergdahl's trial from August until February to provide time for resolving disputes over the defense team's access to classified documents.

Bergdahl’s violation of his ‘General Orders’ resulted in the death of several.
For non Veterans, the General Orders are among the very first rules which Army Recruits (presumably other Services as well) are required to memorize. (Google provides details.)
Indeed, Bergdahl should have been tried and convicted at once upon his being placed back into the custody of the Army.
That entire process might have consumed a full 10 minutes where upon he could and should have been tossed sans parachute from a moving airplane at 10,000 feet or so.

The pardon power of the President is absolute except with respect to impeachment. Article 1, Section 2 of the Constitution states: “The President shall be commander in chief of the Army and Navy of the United States, and of the militia of the several states, when called into the actual service of the United States; he . . . , and he shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment.”

How can Buckwheat pardon bergdahl when he hasnt been convicted of a crime, only charged? (The court martial is the trial). It appears that the presidential pardon power is absolute and he can pardon anyone at any time, including himself, but with risk to his historical legacy.

It will be a sad day if numbnuts actually pardons this traitor. (If that happens, I would hope that the families of the brave soldiers killed while trying to rescue bergdahl will influence the traitors longevity).
