BERGDAHL TO BE COURT-MARTIALED UNDER NEW COMMANDER-IN-CHIEF

FORT BRAGG, N.C. (AP) -- Army Sgt. Bowe Bergdahl, who walked off his combat outpost in Afghanistan and spent five years in captivity, will be court-martialed under a new commander-in-chief.

A military judge decided Tuesday to delay Bergdahl's trial from August until February to provide time for resolving disputes over the defense team's access to classified documents.

I don’t know if the Presidential Pardon applies to courts martial unless as a final measure of appeal of an already convicted serviceman.

How can Buckwheat pardon bergdahl when he hasn’t been convicted of a crime, only charged? (The court martial is the trial).

I'd rather he be tied stomach forward to a 155 cannon barrel in a full Cannon Battery; one gun at a time firing with in a slow 10 count between each gun firing. He being the tied to the last one to fire.

I may be wrong, but I don’t think the UCMJ has a “pre-emptive pardon” provision.
