Giuliani: ‘No Question’ Trump Muslim Ban Violates First Amendment

11 Dec 2015 Thursday night on Fox News Channel’s “Hannity,” former New York Mayor Rudy Giuliani said Republican presidential candidate Donald Trump’s proposed ban Muslim for entering the Untied States would violate the First Amendment of the Constitution.

Giuliani said, “I think we have to be very careful about who we let in. I don’t think we should let any of the refugees in. I think they should be put in a safe zone in Syria, but if you do a ban on all Muslims, I have no question that you violate the first amendment. The reality is if you let no one in, you could say well, they have no Constitutional rights but once the government sets up a system, the government cannot discriminate in the way it applies that system. So the minute the government sets up an immigration system it can’t use religion as a test or race or gender as a basis for why someone can’t come in.”

He continued, “We have to tell people things that are realistic. Thousands and thousands of Egyptian people from Dubai, people from the Arab Emirates, we do business with them. We own businesses there, they own businesses here. We trade oil, natural gas.”

He added: "We don’t have a right to ban all Muslims…How do you stop a businessman who’s been coming back and forth to conduct his business every month. You cannot establish a ban on all Muslims, And also if you did that, you would really take that population and start radicalizing a lot more of them if you did it. To me, it’s not a sensible proposal.”

Since Giuliani is being considered by Trump for head of DHS this information may be useful to vet him for that position.

Last I heard our Constitution did not apply to foreign people outside the Borders of our Country and territories. IMHO if hes this wrong on such a fundamental Constitutional concept as Jurisdiction then he is the wrong person for this position.

It was my understanding Trump was speaking of the 100,000’s of refuges that we cannot correctly identify. Not an arab business man. Am I wrong??

I haven’t read this through but the title confuses me. How can a Muslim foreigner be granted 1st Amendment rights? Please tell me what I’m missing.

Also, I assumed, wrongly perhaps, that the ban is about people coming here to LIVE not businessmen who visit.

First thing I thought of.

There is no "right to enter" the United States. The Religious Test he's concerned about is about who can be in the government.

But we don't have to be fools about that either. If the Communists declare themselves to be a "religion" tomorrow, do we have to be credulous morons and buy it?

Islam is a political movement disguised as a religion. Only fools don't see this. Could you say the same about Christianity? Possibly, but the founder of that religion drew a clear line between his church and the government.

Contrary to what Guiliani thinks, the First Amendment doesn’t cover people in other countries, and there is no constitutional right for anyone to come here. Carter ban Iranians, and deported about 15,000 of them.

That’s what confused me. I don’t believe Trump is about banning business people who travel here for business purposes. It’s about refugees.

After Trump’s initial statement following San Bernardino, one of my (hopelessly liberal) sons moaned that (X), their dear Muslim friend, would not be allowed into the US from her current home in Canada. I had to remind him that (X) is already a US citizen, and, further, when she lived here, held a security clearance to work in the Pentagon. She’s hardly an unvetted Muslim; there are thousands of them who’ve been properly vetted. ALL of us have to understand the difference.

No foreigner has an inherent Right to cross our borders.
